Police certificate with 'no live trace' for abh & stealing

Hello there does anyone know if someone with 'no live trace' on their police certificate for somethings that happened over 40 years ago will be allowed a visa. The crimes were stealing and actual bodily harm - 2 seperate offences at different times both went to Magistrates court and resulted in small fines. Do these count as 'moral turpitude' The stealing was actually taking 6p (yes in old money-it was in the 60s) from a broken drawer on a pinball machine and putting it back in the machine to play pinball, the actual bodily harm was comitted while arguning with a friend, both had been drinking and the 'friend' reported it the next day as his shirt had been ripped too! So fines were issued I think one was £5 the other £10 and a new shirt! I know these should be taken lightly as they were crimes but how will the interviewer at the Embassy see it? If anone has any similar experience I would be grateful or any of you know what may be asked please?

You will be fine, they care about drugs or prison sentences of 12 months or more. Also after 40 years those offenses are well and truly spent.

I have a Theft Charge and a Breech of a community order on my record from 2009. Even though the breech was not my fault but hey ho!

we have filed through the NVC in the USA as our son is now a US citizen and we just dont want to get to the Embassy and be turned down. We did think about applying for AOS once in the US but I dont know if that would be better or not?

You will not be in a category to apply for Adjustment of Status (AOS).

If your son filed for you, your visa will be an immigrant visa, meaning you get permanent residence in the US (greencard) when you enter the US. There is no need to do AOS to get a greencard because you will already have one. You are expected to live permanently in the US or you could lose your greencard.

You will not be in a category to apply for Adjustment of Status (AOS).

If your son filed for you, your visa will be an immigrant visa, meaning you get permanent residence in the US (greencard) when you enter the US. There is no need to do AOS to get a greencard because you will already have one. You are expected to live permanently in the US or you could lose your greencard.

thanks for that but we wondered about going out and completing the process out there instead of here in the UK but we still have to sell our bungalow yet anyway!

That really isn't an option. You have to get the immigrant visa processed at the embassy in London. You can visit on VWP for up to 90 days, but you can't move to the US until your visa is approved. Also you do not file through the NVC. Your son files a petition to USCIS. When it is approved, it goes to NVC to process. Then it goes to London where you apply for the immigrant visa.

If your police certificate says no live trace then you're clear.

I know my timeline sucks, but my husbands P.O.E was on January 7th, 2013!

Greencard in hand! After almost 4 years, WE DID IT!

If your police certificate says no live trace then you're clear.

No LIVE trace means there are old crimes that have expired. The USCIS want to know about every crime, expired or active. You have to be honest and tell them about everything. It's up to them to decide if it's relevant or not.

Of course i am NOT advocating him to be dishonest!

When will he have a chance to tell them? They never asked my husband if he had old/expired/expunged crimes.

On form DS-230 Question 41: Have you ever been charged, arrested or convicted of any offense or crime?
