Hi VJ members,

I'm a US resident in the process of removing my conditions,I would like to bring my sister (make her a US resident)... She has been in the US before as a tourist. is this possible?if yes, can you please point me to the right resources,forms,etc.

if no, are there any other alternatives? adjusting my parents first then they can adjust her status.

Only US citizens can petition their siblings, you would have to wait until you become a citizen to do it. Anyways, it's a process that would take over 10 years. You could try petitioning your parents first but again, it would be long until your sister can become a permanent resident of the US, if approved.

Relationship and I-130 Process

Sometime in October, 2011: We met online talking about Argentina.
Later in October: Met in person in Philadelphia and became good friends.
March 4, 2012: Became girlfriend and boyfriend, officially.
March 21: Gloria leaves the US at the end of her J-1 Visa.
April 9: Got engaged!
May 12-26: Chris visits Buenos Aires.
May 18: Got married in Argentina :) Happy day!!
May 29: Sent out I-130
June 4: NOA1 received.
August 17-20: Chris visits again.
September 22-29: Chris 3rd visit, Gloria's birthday!
November 11-January 5: Chris stays in Argentina almost 2 months, Gloria is happy!
December 28: NOA2 YAY!!!
December 31: Package received at NVC.
January 18, 2013: Got case # and IIN.
February 6: Case complete!!
February 11: Interview assigned.
February 25: Package received at Embassy in Buenos Aires.
March 18: Interview Approved!!
March 28: Visa received.
March 29: Houston POE

April 11: received greencard!!!!!!!

January 9, 2015: sent out form I-751

It will be many years before your sister can immigrate to the US.

Under any scenario for bringing your sister, it will be years.

As a US citizen, it would take you over 10 years to petition for your sister.

As a US citizen, it woul take you a year to bring a parent to the US. It will take 3-8 years for a LPR parent to petition an unmarried child.

Also note that if she comes as a tourist, she has to maintain legal status for the whole period (which is pretty much impossible for 10 years) - otherwise when her priority date becomes current she will be denied.

I might be misunderstanding. A few questions to clarify:

1. If a USC petitions for sibling (the long 10+ year process) and that sibling later applies for non - immigrant (tourist) visa, it could jeopardize the first petition?

2. Since the wait for a sibling is so long, what about other options, like USC later petitioning for parent, then that immigrated parent petitioning for the sibling (their child), which we know is faster?

2a. But does doing that while waiting for the initial petition cause any problems?

3. Earlier in the thread it appeared that multiple petitions could be filed at the same time. What if the sibling, while waiting, wants to enter on student visa?

I might be misunderstanding. A few questions to clarify:

1 - no

2 - you can have multiple petitions pending

2a - no

3 - he/she can, tho it might be a hard to do, since a student visa in non-immigrant visa, so while he/she has one/two/multiple petitions pending, it would be obvious that he/she wants to immigrate to the US
