Hi Vj`s We have read several posts but they dont necessarly fit at our situation and some other posts so we got some questions we apreciate any responses :innocent:

Here is our Situation: We already filed K1 12/27/2012 - Got NOA 1 - 02/01/2013 and waiting for NOA 2, My fiancee have a 10 years old son, he was mentioned in our petition.

He will not be able to come imediadlly with her to US due to school in Brazil and we would like to organize our life to recieve him first,

Now here`s our Questions :

1- How long do we actually have my stepson under K1 visa?

2- How`s the steps for k2? we already mentioned his name on forms of k1.

3 - My Fiancee is able to return back to pick up her son? when? :help: :help:

4 - The son have to do Biometrical exams? When? :unsure:

5 - Do we have to pay any aditional taxes, once we have him under k1 petition? :huh:

The k-1 visa has an expiry date of 6 months after issue. The k-2 holder must follow within 12 months of k-1 benifactor entering the country.

You need to apply for both visas once you get NOA2, and pay two fees. Biometric exams are on AOS once you are married. You will need to send in AOS seperately, so again two lots of fees.

Her son will need to go to the interview at the consulate in Rio de Janeiro with her, he needs the medical exams and all the vaccines necessaries.

Almost all the forms for K1 should be filled for k2 and 2 fees.

Biometrics is only for AOS stage.

I came with my 3 children and understand a little bit about k2 ;)

I don't know if the rules are different in other countries but in Vietnam

1) your son has 1 year after the visa is issued to him.

2) You will need to file his name once you receive package 3 from the Consulate

3) Your fiancee needs to apply for a temporary permit to travel outside the U.S(that permit is not a guarantee that she is allowed to come back in the U.S)

4) Bio exam takes place the same time your fiancee does her

5) You need to prove you have income to support him.

I'm no expert, but if the Mom is traveling back after K1 entry and marriage. She will need to get AOS and ?? I think I read AE? it's what will allow the benificiary to travel outside USA and re-enter. Without this you can't re-enter USA so be careful. Some one else chime in with what I'm thinking of :help:

I'm no expert, but if the Mom is traveling back after K1 entry and marriage. She will need to get AOS and ?? I think I read AE? it's what will allow the benificiary to travel outside USA and re-enter. Without this you can't re-enter USA so be careful. Some one else chime in with what I'm thinking of :help:

Yes, I can help you. We have two sons that came with Alla. Congratulations.

I strongly recommend you bring the child with her, not for immigration reasons, but simply because while stressful I fully believe this is something you need to do as a family, it helps to establish you as a family and YOU as a father figure. I speak from experience. This is a valuable time for you to establish yourself with your new wife and child, do NOT miss this opportunity. Just DO NOT.

1. Your step son can apply for a K-2 visa within 1 year of the issuance of her K-1 visa

2. Same as a k-1 minus the DS156K form. All other forms and fees and medical exam are the same. A 10 year old does not need a police certificate

3. Your fiance can go back to get her son after she has an AP or a green card

4. Children under 13 are exempt from biometrics

5. No taxes. You will pay additional FEES. Visa fee, AOS fee and all other fees are the same as a K-1. Think "K-1 x 2" IF he files for AOS at the same time as the mother you save $400 on the AOS fee.

I will say again...BRING HIM WITH HER. Not for immigration prposes but for FAMILY purposes. This is going to be difficult for your fiancee, I cannot even imagine how much MORE difficult it will be if she cannot be with a 10 year old son. Let me be the one to say it...if he does not come with her you have increased the chances of the failure of your journey exponentially. ONE of our sons came later and he was age 18 AND away at college at the time (so he would not have been "with" Alla anyway) and THAT was bad enough. Do not try it with a 10 year old.
