Co-Sponsor?

My husband is the USC, we filed in 2011 for his Canadian permanent residency and were approved, he moved to Toronto to be here with me in late 2011. He's been in Canada for over a year now and we are now looking to move to Florida. My concern is meeting the financial requirements - when he was working in the US, he has always been making more than 125% of the poverty line. He is making more than 125% of the poverty line here in Canada as well.

My concern is because we are both living here and do plan on relocating to Florida together when I am approved, what should we do about the financial requirements? We have confirmed with his parents that if need be, we can use his father as the co-sponsor. I'd prefer not to as we will be moving in with them initially until we can find a place to rent and I hate being a bother to family.

Please advise? Use my FIL as a co-sponsor? Or send our paperwork without my FIL as co-sponsor and hope for the best?

You will either need a co-sponsor, or your husband will need to move back and start working again

Well if your husband doesn't have an income in the us you do need a co-sponsor.

Send in your papers without meeting the income requirements and you will be denied.

The others are correct: either your husband moves before you and gets a job, or you use a co-sponsor. The only other option is to sponsor on assets, if you as a couple of significant savings/ property etc.

If he were to move ahead, say hypothetically in two months, and I'm hoping that we receive NOA2 in a few months, will his few months of employment in the US be enough to prove he will make more than the requirement?

TBH I don't want to be separated from my husband again..it was hard enough doing the long distance for the first round of Canadian PR/redtape back in 2011. Now we are finally together, we would prefer to stay together throughout the entire process if possible.

Then accept the offer for a co sponsor, that's the only way that the consulate will approve your petition if he does not have any income from a US source. Also, make sure you study up on proving that he will re-establish domicile as from what I understand the consulate in Montreal is very harsh on that point

I have been reading up on it and it's absolutely terrifying. It's already daunting enough to have to leave everything I know but then to be drilled about where we are planning on moving and when and prove it all. We do have a letter from my in-laws stating we will be staying with them until we are up on our feet, etc.

Two months is probably not going to be enough.

Accept the generosity of your FIL or endure a long separation. You don't have the option of going without a Joint Sponsor when your husband has no US income.

If we use my FIL as the joint-sponsor, will that be easier to prove domicile?

No, having a co sponsor has nothing to do with proving domicile, it won't make it easier or harder.

No need to be sorry, that's what this forum is for, weird questions that you normally can't get answers through the guides and stuff!

I suggest reading it and seeing what other people have needed to prove domicile. No matter how you cut it, your husband is going to have to show that you guys have a place to move and an active plan to establishing your life in the USA. He may have to move ahead of you for a month or so to get things set up. I'm not sure exactly because this isn't an issue I have so I haven't read up completely on it. While to you, Toronto and Florida seem far apart, it's not like flying from the UK, or Thailand or India. That is why Montreal is a stickler for domicile; we're on the same Continent.

I ended up posting in the Canadian domicile thread as well. Such a bloody headache. It wasn't this hard when I did hubby's Canadian PR paperwork.

We will be getting my FIL as the co-sponsor, already asked him to get the required paperwork now.

As for proving domicile, hubs and I are in discussion on whether to have him move back to FL ASAP and establish domicile or stay here in Canada and have proof for re-establishing domicile. What's frustrating is that he does have mail sent to his US address at the moment (currently his parents) but I have a gut feeling that won't even be good enough as proof.

Tough bit is we already dealt with the "long distance" relationship for over 1 1/2 years , and have finally been living together for the last year in Canada and may now need to separate soon for the US paperwork, it's heartbreaking

You have quite some time before you need to establish domicile so don't sweat it too much. It needs to be done before the interview but that is most likely 6+ months away if not more if you have just filed or haven't yet. I'm back on the mobile and can't see info atm. sorry.

We just sent it in mid December, NOA1 email on dec 21, no hard copy yet. I know it'll be months until our interview, I just want to make sure we have everything ahead of time
