I-864 Affidavit of support

Hi :

I am a USC and have applied for my moms 130 which is pending approval. My situtation is that I am without a job and need help in I-864 Affidavit of support.

I was on A CONTRACT IT Project from June 2012- Nov 2013 billed at $50/HR. We have our own house and I am the primary applicant on the loan . We pay approx 1100 as mortgage including tax and CDD. We did a 30% down paymnet for the 250K house.

My wife is a full time employee and not very supportive at times. She is @ a 70K salary and not willing to be a co sponsor with me for my mother for unknow resons.

I have close to 35K in bank. Will my moms petiton be approved looking at my financial situtation. I am not able to take a job because , I need to take care of my mom health back in my home country and travel back any time the 1-30 gets approved , do do the rest of the paper work including medical. That's why i am stuck without a job.

We have filled taxes together till date and the avg earning on the 1040 form for the last three is 100-140K.

Gurus and sr... on this forum please give me your views. I am based out of FLORIDA. Not sure whats the poverty line limit in this state.

You will have to get a co-sponsor what you have in the bank is not enough. You have to have 3 times what amount you lack. So that's your household number plus mom. Look at the --864P poverty guideline form. I think you need around $23K.

Sorry to hear your wife isn't onboard.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I do not believe you can use your house you live in if that's your only house.

Go to the guides and really read through the I-864 information of assets.

Is it possible to hold the filing of DS 230 and paying the AOS fee, till I can find a job. I can hold on the I-130 approval and wait to get a job .

Finding a job is only part of it. USCIS likes to see long term stable income.

Your best bet is to find a Joint Sponsor for your mother.

Thanks for responding. I can find a job and start earniing $45-50/hr/. I am stressed out becausej , i am the only son and my mother is all alone in our home country.After my Dad passed away in 2010, my mom went thru a bypass surgery and totally depending on me. I have some relatives suporting me but can expect them for life long. Wife as usual not getting along and not willing to be a co sponsor. I have last three year returns with 100k plus in earning filed tax return together.

Really dont understand what to do. Once I get the 130 approved need to rush back home for me to take care of consular processing, if things work out.

Not sure how 2 handle this...weep day in day out...

Finally my wife agreed to be a co sponsor . She is a full time employee with $ 80k per annum salary. Will that help..... I earned $44K in 6 month last year from June -Nov 2012. Currently I have some offers but am not able to interview because of my moms immigration as I need to Travel.. to help her in the immigration process.

Will this INCOME help me to over come the Affidaviat of Suport...... Please advice..
