AOS from K1 - NBC - 4 months and counting...

Hi Everyone,

I sent my AOS, EAD and AP applications, which were confirmed received at NBC 1st September 2012. I had an RFE for a photo copy of my joint sponsor's passport bio page, which we forgot to put with the application. This was sent and confirmed as received by the NBC 28th September 2012. Both my EAD and AP were approved 31st October 2012 and I received them about 2 weeks later. I have since been out of the country for a family reunion and entered back in on my AP with no problems at all. But no word yet on my AOS. I called the USCIS to follow up and they said I should have received a decision within 60 days and, as it has been 4 months, they have sent a service request, which I'm yet to hear back about. There is another person here (in Utah) who is in a similar situation (from another country, not Australia), but has only been waiting 2.5 months. They went to an info pass appointment in Salt Lake City and they were told that AOS applications from those with K1 Visas won't require an interview here, that the AOS application will eventually be forwarded to the CSC and to just wait 6-9 months for their green card to arrive in the mail. Is this right? I've not heard of a state not requiring interviews for AOS, or there not being an AOS interview anymore, or a green card taking 6-9 months. Has anyone else experienced this?

K-1 AOS does not require an interview, though it can have one. It seems to be about 50/50, and it is not state-specific. If you get transferred to CSC then that generally means you will not have an interview, and yes, it takes around 6-9 months if you get sent to CSC. If your file gets chosen for an interview, then it is usually faster but with the stress of an interview.

Yes it does appear that some green cards are taking 6-9 months. Our time lines are very similar and we have not heard anything either. There is a thread for september AOS from k1 filers - you may want to check it out - it is helpful.

I'm so glad I found your thread! I am in the same situation. I applied for AOS in August and got an RFE for tax information. I replied and they received it Sept. 18th. I got my EAD and AP shortly afterwards. Now I guess we just have to wait!

I have been waiting since July. I just got an RFE in the mail for my marriage certificate and sent a copy back. They received it yesterday and when I went to check my status on the website this is the message that I got:

On January 24, 2013, we received your response to our request for evidence. This case is being processed at our NATIONAL BENEFITS CENTER location. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283. We will notify you by mail when we make a decision or if we need something from you. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed.

I'm hoping that this will be rectified soon.
