Hello VJ'ers,

So I am now in the next step of my residency crisis, and I'm really running low on self-esteem and moral. The amount that I have had to go through in the past year has really taken a toll, and I guess it wasn't even nearly over.

I called several times over the last few months to ask for updates on my case as I had received no information or anything on my case and was quickly approaching the 12 month mark for my i751 removal of conditions. The agents I spoke to repeatedly told me that the case was still pending and that I just needed to wait. On January 18th they finally decided to send me an RFE, which was meant to be sent on October 24th. Apparently the letter was returned as undeliverable. I finally received it on January 19th, but amazingly that was the last day I had to respond by.

I have no idea what to do, obviously my case will be denied due to the fact that I never replied, but I never had anything to reply to. I never received anything, and even after multiple phone calls I was still left in the dark.

I'm terrified, my life that I have spent 3 years building here feels like it's coming to a sudden, completely unfair halt. I'm sure I will have to get a lawyer, so does anyone have any recommendations for the Orlando, Fl area?

What comes next? Am I waiting for immigration officers to knock my door and take me to the airport? Is there anything at all I can do?

Send the RFE back Tuesday with 1 day delivery with a note that you received the RFE on Jan 19. Make INFOPASS for Tuesday. Call USCIS and make sure that your address is correct, as the RFE was undeliverable the first time. Relax. Worst case is an appeal or a refile, not a deportation. But I don't think that will happen either. Have a cuppa.

Your problem is normal for this difficult process. Its tough on our confidence levels. You have to work on your mental conditioning as you go through this.

Whats happened to you is simply a product of how busy they are. Its good in some ways because they are at least working on cases and one is yours. The RFE may seem bad at first but it really means someone is working on your case and has discovered something you left out. This is probably something simple to fix. Once this is done your case will move forward. Mine was complete two weeks after I responded to the RFE.

No matter when you got it send in the evidence they requested with the copy of the letter they sent. You could explain why its late in your submission.

If you really feel as bad as you say after understanding what to do I suggest you make an INFO PASS appointment to go see USCIS so you can speak to them in person. You could have done this at any time in the past to help yourself get personal info.

Check your address with USCIS and at your post office. My daughters docs were sent back because I didnt put her name in our mail box.

I doubt anyone will knock on your door.

The suggestion for INFOPASS would only be for your peace of mind, and to make a record that you have not abandoned your application. You are actually going to be zero business days late because the 19 was Saturday and Monday is a holiday and your package will arrive Tuesday, so I expect everything will work smoothly. Just relax.

Agree with Harpa. You replied. It will all be okay. Think positive. Worst case scenario you have to appeal. Have you kept the envelope from the RFE? If you didn't, I would. It will have the post-mark on it.

Have you moved since filing? Are you able to ask USPS why the letter was returned (they should have it in their system that they returned a letter - maybe)?

Good luck!
