Hello everyone,

I am getting ready to turn in the AOS/EAD paperwork for my (now wife) who is here on the K1 Visa. We were married within the 90 days and have had no issues this far. As I am filling out the I-765 I am concered with my answer to item 16. "Go to the Who may file form I-765? section of the instructions. In the space below, place the letter and number of the eligibility category you selected from the instructions. (for exaple (a)(8), © (17) (iii), etc.).

I currently have (a) (6) as my answer which is for K1 fiance of U.S citizen. But I see © (9) in the tips and exmple forms on VJ. Reading the definition of © (9) it seems as if this for people who file the EAD after AOS is in progress. Since I am filing together which one should I select. Normally I do well on these forms and do not get confused but these categories are confusing. Any help on this matter would be much appreciated.

C9. A6 category results in an EAD that expires when her I-94 does. C9 is based on pending I-485 and is valid for a year.

2/06/13: APPROVED!
