hello ,

We finaly got our immigrant visa. We are still living in Germany and my husband intends to travel to the US

for 2 weeks with his visa in order to prepare a few things and go to some interviews. I (US citizen) will stay in Germany as we have a small baby. Then about 2 weeks later we will leave together to the US. As he is only staying for 2 weeks in the US he will not have his green card yet, but he will travel to Germany again.

How does this work ? Because I know he usually would need his green card to return to the US...

Does he have a packet of "stuff" to carry with him and hand over at the POE? I wonder if the GC is in the packet and will get handed to him upon activation of his visa.....

as he activated his visa yet?...

If he hasn't when he goes to the US he will hand over his visa packet and he will get a stamp in his passport that is good for a year... this will act as his green card till he gets the actual green card in the mail a few weeks later... It usually takes about a month or so to get the green card...

but he would be free to travel after he has got the stamp in his passport...

Green card is not in the sealed brown packet, it gets mailed a few weeks after arival in the country.

Is now a US Citizen immigration completed Jan 12, 2012.

John,

For some reason I'm thinking that the USC must enter the USA at the same time as or ahead of the immigrant. I know I chastise others for posting "I read someplace that ....", but if correct I'd hate for there to be a problem that he could have been alerted to.

It's true--I read this thread this morning and something snagged my mind. It came clear as I was rereading it just now. Then I saw your comment. :)

Now, I've posted the details before, but where/when. It's to do with the I-864 & domicile.

General Information & Frequently Asked Questions –Affidavit of Support Forms (I-864 series forms)

If the sponsor establishes U.S. domicile, it is not necessary for the sponsor to go to the United States before the sponsored family members. However, the sponsored immigrant may not enter the United States before the sponsor returns to the United States to live. The sponsored immigrant must travel with the sponsor or after the sponsor has entered the United States.

I wonder if hubby can simply travel as a tourist & speak to the CBP; ask them to ignore the rule or ignore the IV.

If it sounds too good to be true...

The sponsor is the USC spouse, in this case Flea.

Or do you mean that maybe they make exceptions for the 'rich and famous'?

I was thinking if the sponsor wasn't the USC spouse... like maybe a family member already living in the US....

but I didn't know who their sponsor was...

The sponsor is ALWAYS the USC. They may have a household member living in the USC domicile, if they were using their income to meet USCIS requirements. If, like in my case, the sponsor had maintained residence in the US(i.e. temporary resident overseas), then would that mean the sponsor must accompany the immigrant to the POE, too?

6/30/07 - Mailed I-751 via Priority Mail with Delivery notification

7/02/07 - Delivered to USCIS in Laguna Niguel,CA

7/07/07 - CSC returns I-751 packet because we used an older I-751 version. Mailed I-751 with latest(02/07) version via Priority Mail with delivery notification

7/09/07 - Deliverd to USCIS

7/10/07 - NOA date

7/12/07 - USCIS cashes check

7/21/07 - NOA received(GC extended for one year)

7/24/07 - Biometrics notice received

8/10/07 - Biometrics appointment in W. LA

8/28/07 - Card production ordered

8/29/07 - Approval notice received online

8/30/07 - Approval notice recieved in mail

9/04/07 - 10 yr GC received in mail

Point of clarification: the sponsor is always the USC spouse in the case of a marriage-based immigrant visa, which is the case here. MarilynP would be correct if this were a K-visa situation.

In which case we wouldn't be having this conversation because the issue of arriving on an Immigrant Visa before the sponsor would not exist.
