"Immediately Available Immigrant Visa"??

Timeline

If you live in the Dallas jurisdiction and submitting the I-485, it says if you have an immediately available immigrant visa you MUST apply in person.

What's That???

Our K-1 is "immediately available" because we have it attached to her passport, but I am VERY sure that's not what it means. What are they talking about???

Feb 16, 2006 Sent I-129F

Feb 27, 2006 NOA 1 Notice Date

May 8, 2006 Received NOA 2, Notice date: May 1

May 22, 2006 Received NOA 3, Letter dated May 18! Papers SHOULD be in Bangkok "within a week"!

June 3, 2006 Jat Received Packet 3! But for some reason, they also sent her the I-134. Thanks folks, that's REAL convenient for me!

July 15, 2006 The Young Lady recieved Packet 4! Interview is scheduled for August 15! WOW!!!!

August 15, 2006 Approved! Wow!!! Now on the The Next Step!!!! ;)

September 6, 2006 She's Here!

October 4, 2006 Hitched!

Basically, as the spouse of a US citizen, the immigrant has a visa number immediately available, and should apply in person.

From the USCIS website:

"People who want to become immigrants are classified into categories based on a preference system. The immediate relatives of U.S. citizens, which includes parents, spouses and unmarried children under the age of 21, do not have to wait for an immigrant visa number to become available once the visa petition filed for them is approved by USCIS. An immigrant visa number will become immediately available."

Timeline for Naturalization:

Day 1: Application delivered to AZ

Timeline for Removing Conditions:

Green card received 117 days after application was delivered to USCIS

Timeline for AOS:

Green card received 120 days after application was delivered to USCIS

Conditions Removed! Ten-year green card received 6/24/2009. No more USCIS for a very long time.

They are not referring to the K-1 visa - it is not even an immigrant visa. You are applying to adjust status as a spouse of UCS, who entered as a K-1 fiancee and married within 90 days of entry, and that gives you an immediately available immigrant visa.

If you were applying to adjust status as, say, a spouse of LPR, you would be subject to an annual limit and an immigrant visa would not be immediately available - a significant waiting time would be likely.
