Can my husband get his tax returns from 2012 right now in jan 2013??

From what I've read, the IRS will begin accepting and processing returns January 30, 2013 for 2012 returns. I don't know what that means in terms of him preparing it and mailing it before then, though.

Sorry I guess it is Jan 30th, it used to be mid January. Anyways, you don't NEED to have a 2012 return for an interview in February.

Could my interview be dined because my husband couldn't get the 2012 tax returns because it start on jan 30 ???

No since he has until April or something to do his 2012 taxes they won't require them...

My sons AOS and IV bill paid March 23rd (status in progress)
My sons AOS and IV bill shows as paid March 26
My IV bill paid March 26
Both packages sent on March 26
My IV bill shows as paid on March 27th
CC on both cases March 30

Current record holder of fastest through the NVC :D

Medical exam in Stockholm April 13th
Interview on May 16th !!!
POE Anchorage July 12th!! 2012

July 2015 n-400 in the mail

September 2015, interview

October 23rd 2015, Oath ceremony!!!!!​​

The IRS is always accepting tax returns, however, not all the forms and instructions were ready, last time I looked. Most of the time, they are ready in July with the current years forms, but since Congress and the President didn't agree on 2012 tax policy until the start of this month, the IRS is falling behind this year.

ETA: I just checked, and the 1040 Tax Tables are not ready yet.

It's law that all W-2 and W-4's have to be mailed out no later then Jan 30. Most companies wait until the very last second. I never get mine before the first week of February.

Relationship and I-130 Process

Sometime in October, 2011: We met online talking about Argentina.
Later in October: Met in person in Philadelphia and became good friends.
March 4, 2012: Became girlfriend and boyfriend, officially.
March 21: Gloria leaves the US at the end of her J-1 Visa.
April 9: Got engaged!
May 12-26: Chris visits Buenos Aires.
May 18: Got married in Argentina :) Happy day!!
May 29: Sent out I-130
June 4: NOA1 received.
August 17-20: Chris visits again.
September 22-29: Chris 3rd visit, Gloria's birthday!
November 11-January 5: Chris stays in Argentina almost 2 months, Gloria is happy!
December 28: NOA2 YAY!!!
December 31: Package received at NVC.
January 18, 2013: Got case # and IIN.
February 6: Case complete!!
February 11: Interview assigned.
February 25: Package received at Embassy in Buenos Aires.
March 18: Interview Approved!!
March 28: Visa received.
March 29: Houston POE

April 11: received greencard!!!!!!!

January 9, 2015: sent out form I-751

If your husband has income to report, he should be getting his documents W-2, 1099-? and other tax forms by end of January - W-2 - through end of February - 1099-? etc., so chances are he is not ready to file just yet.

However, if he has all the paperwork he needs, it would behoove him to wait until the IRS has finalized the code for 2012, so that he will not need to file an amendment after the fact.

The latest info from the IRS is they will have the new code available by end of January.
