I-129F denied thinking of filling for a I-130

Hello VJ member,

My fiance recently got denied for a k-1 visa because my income was too low. I did included a co-sponsor but Bangladesh consulate told us in the day of the interview that a co-sponsor for a k-1 visa was not accepted and that this was only validated for a I-130 petition. The officer also told my fiance to get marry with me and to filed the I-130 petition and that they were going to change my I-129f petition to a I-130 petition. But I am not even sure if this is possible or that means that we have to start all over? if any one has gone through a similar situation what did you guys did? feedback will really help on this situation.

27 December 2013

I received email from USCIS- On December 27, 2013, we transferred this case I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN to another office for processing and sent you a notice explaining this action.

30 December 2013

I received second email from USCIS- On December 30, 2013, we transferred your I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN, to your local USCIS Office for further processing.

31 December 2013

I received third email from USCIS- The I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN was transferred and is now being processed at a USCIS office.

2 January 2014

Received Transfer Notice hard copy. Case was transfer to Texas Service Center.

7 February 2014

Received email and text msg that I-130 was Approved!

13 February 2014

Received NOA2 hardcopy.

24 February 2014

Received email and text msg that our case was shipped to NVC.

22 April 2014

Received DS-261/AOS Bill and submitted DS-261.

23 April 2014

Payed AOS Bill.

02 May 2014

Received IV Bill and Payed IV Bill.

07 May 2014

Send IV Package.

25 June 2014

Send AOS package.

24 October 2014

Case completed at NVC.

03 November 2014

Received interview letter.

23 December 2014

Interview Date, got green paper sheet (221-g) and was told to submit another Affidavit of Support.

31 March 2015

Turned in the documents they ask for at the interview and told us to wait 60 days for a response.

05 August 2015

Case updated in CEAC from READY to AP.

CASE UPDATED: Aug 9, 10, 11, & 24. Sep 20

Sorry to hear this. Yes, you will need to get married and start the process all over.

Hi. I'm sorry to ask you this. i know its personal, but i just have to ask what u meant when u said your income was too low? did they tell you what should be your minimum income monthly or annually to get approved? i would really appreciate your reply to this coz im also worried about the same thing. please just send me personal message. thank you. :)

Yes you have to start over.

Co-sponsors are accepted for spousal visas because the finanical part is handled by NVC, not the consulate and they accept jouint sponsors. A CR-1 takes approx. 1 year to process and recieve after filing the petition. In order to file the petition you must first get married and include a marriage certificate with the petition. How ong will that take you to accomplish? Add that time to one year.

Another option is to re-file the I-129f for the fiancee visa tomorrow, and get a job which pays enough to meet the qualifications.

I don't think they can change your petition from a K-1 to a CR-1 at the consulate. They will deny your K-1 and you'll have to get married and file for CR-1.

There is nothing to "change". The K-1 was denied. It is done. Dead. :dead:

Start over. Read the instructions, study the consulate you will use, make wise decisions. Get married and file for a CR-1 or get a job and file for the K-1 again
