Nope. Emergency medicaid is available in all states (NY included) to everyone regardless of status. Regular medicaid is not. You can also get medicaid coverage if you are pregnant irrespective of your status.

"Medicaid coverage is available, regardless of alien status, if you are pregnant or require treatment for an emergency medical condition. A doctor must certify that you are pregnant or had an emergency, and you must meet all other Medicaid eligibility requirements."

Sorry but I disagree. I know quite a few people illegal and GC < 5 years on regular Medicaid in NY so I know for a fact it can be done.

Well if they have it, then it would be as Darnell stated- sponsored by the states money and not the federal money as federal law prohibits their money from being used that way. Their cards wouldnt actually read "Medicaid". I mean they would, but they wouldnt. Theres different groups of Medicaid depending on which division of the federal government is footing the bill. Theres Medicaid-Children and adults, Medicaid- Disabled, Medicaid-Healthy family, Medicaid-Elderly. So NY would have had to make their own group Medicaid- XYZ where the state would be footing the bill.

Either way its a bold move on the part of NY. I hope they have the funds to make it last, because that would be awful to give people coverage and then have to terminate it because they cant afford to keep it afloat.

You're selfish for wanting to have legal permanent resident privileges? :blink:

Your husband is incorrect on your stay being legal. While it's true that you fulfilled the requirements for the K-1 (marrying within 90 days of arrival in the U.S.), if you don't file to adjust status and your I-94 has expired, you are technically in "unlawful status."

You will not be able to get a driver's license without formal documentation stating that you're a legal permanent resident, which will not happen until you adjust status -- whether that's first with an EAD or ultimately getting a green card.

If you have the money to return home, think seriously about it. If he doesn't want to sign for you in two years, what will you do? What makes you believe he will change his mind in two years' time?

My husband is not a legal permanent resident yet and he has a drivers license. I believe this varies from state to state. He also has a bank account.

Is your husband already in the US? From your signature and timeline, it doesn't seem so. :unsure:

From which state was the license issued and when? The majority have adopted the "legal presence" requirements in the past few years where you'd either need to provide an I-94 (which can be temporary given the expiration date), an EAD, or green card -- at a minimum -- to secure a license. Since the OP's I-94 has expired and she isn't able to file the AOS given her husband's reluctance to sign the I-864, the likelihood of her obtaining a driver's license is minimal.

if you came one a K1 fiance visa more than likely you won't be able to get a driver's license without I-797C (NOA for AOS) or EAD/AP. some banks will let you open accounts but most won't. you won't be able to work cuz that will be illegal.

have you ever thought that maybe this is your husband trial period on whether he likes you and if he didn't he'll just not sign the I-864. what if he decides that he likes you after 1 or 2 years but still doesn't want to sign it because of he's afraid still. if he won't sign now when he's more in love with you how can you believe that he'll sign in a few years. if your relationship starts with him not trusting you now how do you know he will change at all. i personally think he wants to keep the power over you with this I-864. but it truly it is your decision on what you want to do. i'm sorry if i'm being harsh.

He had one friend whose wife was a Canadian divorced a few months ago(just 3-year marriage). His friend lost one house after divorce. That's why he's worried that we might divorce also.

I asked him before why he applied K1 visa for me if he didn't want to sign this paper. He said he had never known there would be a contract between him and government which threated his finance once we divorced in future. He just hate that federal government's law but not me.

He once said another way to avoid him to sign it was when there was an amnesty issued by the president some day. But I didn't agree that idea.

I talked with my husband again tonight. He said he would sign it after we lived for 1 or 2 years because he wanted to make sure if we would divorce or not when we live together longer. He's an honest guy. So I should trust him. I think w he will sign hen he feels comfortable.I'm still free and I can fly back to China any time I like if I don't want to wait for him to sign. Now I have to be patient. I hope I won't be arrested by ICE.

Just checked the website of DMV here, no need to submit the green card when apply a new driver's license.

Your husband is lying to you, manipulating you, and controlling you. He is trying to make you into his house slave. With your status in the air like this, you will be essentially useless. If you have some money, I would leave NOW. This man is NOT a good man. He purchased you, or is treating you as if he has. He got his new slave to the States, now he wants no obligations to her. If he cared so much about now owing anything to the Fed, he would've moved to China or tried to live with you in a third country; the fact that he brought you on a K-1 and now doesn't want to give you status just, again, proves he wants a slave.

AGREEEEEED!!!! My family friend a sweet young girl married an older man (he was like 15 years older then her) and she met him in Croatia when they both lived there (he was a successful businessman) they traveled together all over Europe and visited her family in Bosnia all the time...he seemed like the PERFECT man.....well he was returning to the US and asked to marry him...she wanted to finish school (she only had like 6 months left) and she would come so they filed for the K-1 visa....

poor thing she was so exited....

she came here and from the moment they began living together (they didnt live together before but spent 2-3 days a week together before) he was mad when she didnt cook....when she didnt clean....when his clothes were not folded and ironed.....and he waited till like day 85 to marry her and when he filed for AOS he began threatening her that if she does not act like a 'real woman' that he would cancel her green card he told her "You are not here to party with friends, or go to starbucks or go to Croatian concerts...you are here to be a wife and thats your purpose" and many people heard him say that when he came to pick her up from starbucks where she was having coffee with her friend...he played with her life and emotions....well smart girl-- she packed up her stuff one night......drained his bank account right before they closed(a good 15k-- he should have thought before adding her name on his bank account--thinking that she will just go to the grocery store) left him a long letter about how shes not a slave and she didnt come here to just iron his clothes and cook him dinner...that she came to have fun with her husband, travel, build a family and live happy and she wasnt happy" she was back in Croatia after being in the US for a year....and shes happy she hated it here she says....

but serves him right....I still see that looser sometimes and I dont even tell him hi.

Our love began in 2010....our Journey in 2012 (January) and now we are at peace until 2014!

--February 2012-- Touch-- Need more evidence.

--February 2012-- Sent more evidence.

--March 2012-- Biometrics and Doctors App (around the same time)

--June 2012-- (BIG PROBLEM) Immigration sent us a 'DENIAL' letter due to not having a sponsor (I thought we didnt need one)

--June 2012-- we hired a lawyer and got a sponsor, got the I-290B Motion to Appeal or Reopen had everything sent off by the end of July 2012.

--October 2012-- OUR APPEAL WAS APPROVED (breath easy, we didn't have to wait too long)

--October 2012-- Work permit sent-- got SSN

--November 26th, 2012-- AOS interview-- Got sent out told to get a translator and new interview date would be sent. :(

--January 8th, 2013-- Second interview...went well but no idea if we were approved or denied....VERY STRESSFUL!!

--January 15th, 2013-- APPPPPPRRRROOOOVVVEEEED!!!!!! (checked on USCIS web site)

--January 18th, 2013-- Card Production Ordered....welcome letter (hard copy) in the mail!!! :)

--January 24th, 2013--CARD IN HAND!!! DONE!!!!!

He has a US driver's license...yes, he's in the States.

His I-94 had been expired 3.5 years when he got his driver's license. All he had to show was his birth certificate, social security card and a piece of mail with his address on it. We live in Illinois.

My timeline reflects my children's journey. My signature reflects Hubby's AND children.

He was on a business trip to Vagas when all this happened.....also dont feel bad she took all the $$ he had PLENTY more in his private account....he didnt even notice it was gone till a week after she left-- keep in mind this was the 90 there were no phone apps to check accounts at that time lol)....HE WAS NOT THE MAN SHE THOUGHT SHE WAS MARRYING.

sadly I have seen/heard these things happen often....it seems to be a sad trend between young immigrant women and grown successful white men......

So what. If you divorce your husband, you being an illegal alien will not affect what you get. Even if his friend had kept his Canandian wife as an illegal alien, she still would have gotten the house based on HER MARRIAGE. HER IMMIGRATION STATUS DOES NOT MATTER TO A DIVORCE COURT. YOUR HUSBAND IS LYING TO YOU!!!!!!!

You are not going to benefit from any future amnesty. You haven't been here long enough. Amnesty is not going to be offered to those who just showed up like you. Do you know that some people have been waiting over 30 years for amnesty? It's still not here.

You are made your choice. You are staying with him knowing that he will not help you be legal. You will have to deal with the consequences of living as an illegal alien who can't work or go to school. In my opinion, you are making a very foolish choice.

Rules have changed. If I remember correctly, we had a poster here some months ago who had been in the US for several years unlawfully but with a valid driver's license. It wasn't until he couldn't renew it he started to seek advise on his unlawful presense.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

You are made your choice. You are staying with him knowing that he will not help you be legal. You will have to deal with the consequences of living as an illegal alien who can't work or go to school. In my opinion, you are making a very foolish choice.

Rules have changed. If I remember correctly, we had a poster here some months ago who had been in the US for several years unlawfully but with a valid driver's license. It wasn't until he couldn't renew it he started to seek advise on his unlawful presense.

Again, it depends on what state you are from. He JUST got his license in 2011. I'll check my DMV's website, but even the OP said she just checked hers and no green card is needed.

I just checked our DMV website. Under identification needed to obtain a license there are 4 boxes. You have to have at least one item from each box.

A. Written Signature:

In this box there are multiple items listed such as credit cards, state ID cards, current drivers license. (my husband has all 3 of these).

B. Date of Birth:

items include: Adoption records, birth certificate, USCIS records (my husband could use birth certificate and others that I didn't mention)

C. Social Security Number:

items include: Driver's License Record, State ID card, Social Security Card (again, husband could use any of these)

D. Residency:

items include: Affidavit - Certificate of Residency, bank satements, canceled check, Official mail, Phone Book (lol), Vehicle Registration Card, Utility Bill (my husband could use any of these.

Driver's License rules are not the same across the countries. Requirements vary from STATE TO STATE.
