I am a Canadian with a pregnant US girlfriend. She is a green card holder soon to become a US citizen next year.

I want to visit her for the birth of the baby and stay for a few months to help out before returning to Canada. How long can I stay and what do I tell the border agent when they ask for the purpose of my visit?

Secondly, would having a baby affect the K1 application for when we decide to marry?

I can answer the second part of ur question, that during the process of k1, definitely it will effects the k1. U need some legal help.

1. I am not sure if she has applied for you on the K1 visa, but she is illegible for the K1 unless she becomes a USC.

2. Canadians coming to the US is quick and easy. Just have your CAN passport on hand. When you get to the boarder tell them you are going to visit your girlfriend. You don't need visa as long as you are a CAN. But to be certain, please call the US embassy in CAN and find out about how long you can stay inn the US. But there's flexibility on the CAN citizens.

3. Not sure when you are planning on getting married, but if you two do get married and she becomes USC, she can't file for you under the K1. Instead, she will file for you under the CR1 visa. It takes about a year to get the visa to permanently stay in the US.

I can answer the second part of ur question, that during the process of k1, definitely it will effects the k1. U need some legal help.

Why?

OP: As a Canadian, you can stay up to 6 months without a visa (but cannot work during that time), so feel free to come for the birth of your baby and stay a while. Never lie to immigration, but no need to tell them everything unless they ask- simply say you are visiting your girlfriend, unless they ask for details.

The only way the K1 will be affected by the birth of the child is that there is an extra person in the household for the affadavit of support. What you might consider doing is getting married while you are down here for the birth of the baby, then have her file for a spousal visa asap. It takes 2.5 years for a grencard holder, but she can upgrade this when she becomes a US citizen. The CR-1 spousal visa has the advantage that you can work right away once you immigrate on it, and it is also cheaper than the K1.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
