I'm not sure if anyone has ever asked this question before but since I don't know the answer to it I'm going to post it here, sorry if you've already answered this question.

As I called my lawyer this morning to tell them that our I-129F petition is at the NVC and possibly will go through I found out that they FAILED to tell me the translation of my birth certificate needs to be from where it was published?! is this true?

I was born outside of Canada but been here since I was a child and never been back....is it absolutely a requirement for my BC to be translated by my birth country?? Can it be translated here by someone licensed, authorized to do so??? If I were to get another BC or have them translate it and send it to me from where I was born it would take at LEAST 5-6 months

The clerk tells me you could have had it done by now!! How the hell am I supposed to know what I need if you don't tell me?!, that's what I'm paying you for anyways! to do the job

plz advice, I really hope I can get away with the translated copy here

yes I know it needs to be translated, BUT does it need to be translated by the SAME authority that issued my BC? or can it be translated it by a licensed notarized person here?

well yeah that's what we thought, and we have it translated by an authorized notary person and ready for when it's needed. One more question though, do you know if we have to include our ORIGINAL non translated BC along with the translated copy?? because she says as the beneficiary I have to send in the original copy along with the translated copy. I have no idea.

Yes at the NVC you have to send both. The original and translated copy of everything. The BC, Marriage cert, and Police report.

here = canada? Yup, absolutely !

Yes, def can be translated by anyone qualified and competent in both the original language and English. All civil documents sent to NVC must be civil documents, unless you're doing electronic processing, which I think is available for Canada? Then you'd bring all originals to your interview.

Does anybody know if an affidavit of birth from mother would be good enough as a secondary evidence? or do I have to have my father write one too?

Before going into a long complex answer about the standards of proof for secondary evidence and what you need when a primary doc is not available-

Why exactly are you trying to get secondary evidence of a birth certificate? Do you not have the birth certificate? Your first post was inquiring about how to get something translated/ So if you have the BC, all you need is to get it translated. You submit the BC in the foreign language along with the translation. Thats it. No need for secondary evidence of the birth.

I just want to know if one wanted to show an affidavit of birth, would he/she need to submit from both parents? or the mother's will do just fine?

Its a little complicated-

First you need to check http://travel.state.gov/visa/fees/fees_3272.html to see if the document you dont have is listed as a document that is available or not. If its listed as available, they will not accept secondary evidence, they will want you to get the primary document.

If theres no BC available and/or your otherwise eligible to submit secondary evidence first you need to show either:

a written statement from the appropriate issuing authority attesting to the fact that no record exists or can be located, or that the record sought was part of some segment of records which were lost or destroyed;

or evidence (such as an affidavit) "that repeated good faith attempts were made to obtain the required document or record."

Then and only then can you submit secondary evidence. Your secondary evidence can be from whomever youd like or consider a strong candidate to give such testimony. The only requirements is that they be of sound mind. One statement from a person who was present at the birth is good, two statements would be better.
