Hey all,

I have a simple question.

I am starting the paperwork for my husband. But before we got married, my husband went for a visa, and on the application he mentioned a few things that weren't true like his where he works and school he went to? will it affect him when I file for him I130?

Please help. I am sending the application soon.

Probably. He obviously lied, since you cannot accidentally misrepresent these things. This is considered fraud. I think they usually bar you for life for fraud. But you should just apply to see. He will have to disclose that he was declined before and the reason he was declined. So they will know, but it's up to them whether or not to deny/bar him.

Maybe someone else could post their opinion on this or post a law showing what the consequences are for previous fraud on a visa.

05/03/2022: Status changed to "The U.S. Department of State approved your application for your passport book. We're now printing your passport book and preparing to give it to you. You should receive your passport book on or around 05/09/2022."

05/05/2022: Passport Received.

05/09/2022: SSA Citizenship Status Updated.

05/25/2022: Naturalization Certificate received in mail.

Thank you for the reply.. i mean he has swtich jobs many time, so i just figured that they will think that he was doing something else. And two the school, why can we use the same information?? and in Ghana how will they check?

I think she is wanting to know if she ought to put down his school the same as he listed it as the Visa he applied for, which was a lie.

If that is indeed what you are asking OP, no. Do not lie on your application. Never ever lie to USCIS.

I can explain it to you. But I can't understand it for you.

I agree it sounds like she wants to lie on this next application to make it consistent with the first, fraudulent application.

All you can do is put the facts down. Please do not make it worst and lie.

And it doesn't matter if its Ghana or the moon. All they have to do is call a university and inquire if said student was there from there to there. Or ask your husband to bring diplomas or documents to interview.

They may notice the difference they may not. But be ready to explain at interview if asked. Do not volunteer the information. But ALWAYS ALWAYS tell the truth.

After reading other posts on here, I really don't think they'll ask about his education background. they're more interested in making sure your marriage is real or not and not about his smartness. My only advice is, don't say anything unless they ask. I've been reading many posts from people that had completed their interview, nada about education. So do not worry about getting a denial. just don't mention it in the interview if they didn't ask. if they ask then tell them the truth. and be persuasive about the reasons you lied. but going forward, never lie onyour application or interview. Ghana is a high fraud country, so be careful and be truthful at all times. Even someone from Ghana lie saying he was visiting his Cousin and later applied for the K1 visa. the consular caught on it but was given a visa after a strong debut with the consular.
