I think we are getting to the point where we might need an expedite. Yes, I know it isn't guaranteed, but I need some advice on how to proceed. Yes, I also know that I've gotten myself into this mess.

I, the USC, am in Denmark right now with my husband, the beneficiary, and daughter, a USC. I've got relatively bad social anxiety to start out with and intermittent depression usually resulting from said social anxiety. However, the longer I've been here my social anxiety, depression, and now general anxiety are getting out of hand. There is an incredibly long waiting list for the socialized healthcare doctors and we don't have the money for a private one (especially after spending the money on a private doctor a week ago). I'm also a little worried that if I get pregnant, it is going to be high risk with a previous history of multiple miscarriages, gestational diabetes, and an emergency c-section. Obgyn care here leaves some things to be desired relative to how my case would be handled in America. I'm also quite worried about a biopsy they took of a suspicious mole on my arm.

So why don't I just go back to America with our daughter and wait it out, might you ask? Frankly, I can't mentally or physically handle travelling with her alone again in my state (she is high needs and screamed and had to be restrained both flights over here) and moving back into the house (that is in the middle of the woods in a town that doesn't even have a gas station) that my deceased father lived in all alone with my daughter day after day is bound to make the depression and anxiety worse. Also, paying for bills at two houses is just not possible in our current financial state.

I thought that since we filed from abroad we would be auto-expedited like some others have been, but it doesn't seem to be happening and I am really worried about my mental state and my daughter's (who is scared of Danish kids after being beaten and bullied and is pretty lonely being homeschooled).

How do we go about filing for an expedite? Do we have the grounds for one?

Nola123, honey, I'm so sorry you are hurting. You and your daughter are suffering severe medical hardship; mental disorders are medical issues. First think of the exact way that expediting your case will resolve your hardship. If the presence of your family together in the US is vital to your health because you can't get the care you need without your husband being physically present with you in the US as your caretaker (as opposed to having a family member or other person as your caretaker), then you should write a letter to that effect describing your situation (ill with an ill daughter, needing medical care in the US that you can't get in Denmark, unable to afford to live away from home or to hire a different caretaker, your husband's presence is essential to your financial and medical well-being) and how expediting your case will resolve it. Present every factor you can think of that results in hardship to you and your husband and that can't be easily solved some other way.

This article has to do with waivers of inadmissibility, which do not apply to you, but it breaks down several hardship types that provide language for you to use when drafting your letter. http://www.ilw.com/articles/2007,0717-scott.shtm

Please don't rely on my advice alone in deciding what to do, but I think the material will be helpful.

I'm a dual US/Hungarian citizen (both by birth; Hungarian citizenship verification TBA), and my husband is a dual British/Irish citizen (by treaty) from Northern Ireland. We are atheists.

I am not sure how good the US healthcare system is if you have no insurance, which you are unlikely to have immediately upon returning?

That being said, you seem to have well documented medical reasons for an expedite, worth a try. Get as many doctors letters as you can, and documentation of your child being bullied.

I hope that the expedite goes through for you! I think you should also consider contacting the congressman in the area where you will be moving to and present your case there as well. Perhaps that will get a move on too after you've drafted your expedite letter. Sending out positive thoughts to you and your family!

Thanks everyone!

If we were to do this, how do we go about it? Do we call first and then send a letter?

We've looked into some other options with me and my daughter maybe going to stay with my family in England or friends and family in the Netherlands to try and pick up my mood and then there will be people to fall back on just in case.

@Penguin Actually I had been covered privately under my mother's insurance and with my 26th birthday coming up and her being kind of worried about me maybe having melanoma (which I'm sure she was overreacting), she actually continued my private healthcare coverage, but any obgyn/doctor care would be the same as I had on Medicaid, which is the professors at Yale's School of Medicine and Nursing. I think all of the Yale Clinics also do sliding scale or free treatment and are quite excellent. Even if that weren't the case, my mother works pretty high up in a hospital and was a professor at a medical school for about 25 years, so we have a lot of family friends who would do us a favor. ;)

Well, I've sent off the request to Senator Blumenthal, so we'll see how that goes.

I was able to file an expedite ovet the phone. I called in and got to an ISO and she filed it for me. I had to explain my situation in detail then you wait five days for them to either accept, deny, or request more information. Good luck...I have GAD and I can't even imagine the strength you must have to be dealing with everything you are dealing with.

I was going to call tonight, but I don't know about it. I'm a little worried that we don't have enough physical evidence. I haven't been to a psychologist in years as my SA was pretty well controlled by the group I went to once or twice a month and my SA makes it hard to contact any old psychologists or doctors. We don't really have access to one over here. I've got the evidence of my daughter's bullying ( including the email I sent to the dean of the local university and CEO of a big company here that are on the board of the school).

I keep feeling like the NOA2 will come any day with so many November filers being approved recently, but maybe I'm just unlucky.

I didn't want to wait on the phone for the ISO, so I sent an e-mail to them outlining the reason for an expedite. The CSR said he wasn't able to do it, which I thought they could....

I thought CSRs could too... but yes the email should get you the same results. I filed in September and Im still waiting so I dunna... everything seems pretty random at the moment. Im not sure how else you would rpove your case other then maybe a letter from the person who ran your group? Could you get that? Just attesting to the frequency you went and stuff.

Did you file your expedite with a CSR?

He had started putting it in and asking lots of questions and reading the requirements off and then told me that he was unable to do it for my case for some weird reason. I think USCIS needs some transparency.

I can probably do that and the woman who ran it was a psychologist, so I'm sure it would do. We'll see what they say, I guess.

I waited for an ISO...Cause Im paranoid and the CSRS seem like they are more drones then anything. I had one tell me she was going to file a service request for me asked tons of questions then told me oh I cant do it and passed me on. I think they get a little overzealous. It never hurts to contact the psychologist who ran the group. Personally I think you have a strong medical reason. I know people will say there is more dire emergencys but they truly handle it on a case by case basis and one persons form of dire might differ from another. Just keep your chin up and remember to breathe and you will get through this and above this :) And in the end youll have one more thing you can list as getting through even though you may be hampered by your anxiety. Keep us posted. If you dont recieve a response i five days I would definitely call back and wait for an ISO.

I agree with speedwell.

-Youre going to need documentation of your condition

-proof that you will have medical coverage or access to care in the US

-proof that there is no suitable or affordable care in Denmark

-proof that your husband is your caretaker or his presence is vital to your mental stability

-proof that if the expedite is not granted and you are forced to return to the US to seek treatment on your own, your family will suffer an extreme financial hardship

Surely you can figure out how to prevent this issue. The US does not expedite for bad planning in this case.

Otherwise I wish you well.
