Hello.. Here I am again posting questions and oh I already have my vaccination sheet transcribe to I-693 and have my flu vaccine too today. Anyway, since we have a lawyer processing my AOS, me and my other half got confused about changing middle and last name (after marriage)since they asked if we have ocurt order regarding changing my middle name, I've been searching google about it but I cant find the right answer and since I'm from philippines.. we change our name traditionally like drop the previous middle name and use the previous surname as a new middle name and take my husband's last name as my new surname. When I search about my State (VA) name change law after marriage in google they only give information about the last name change but not the middle name change. I know that in some state you need to have court order to change your name (legally) but I cant find any information how it goes here in my state. Is there anyone who knows if I need a court order or not regarding changing my middle name? and it makes us confused because when I apply for my SS Card... SSA allowed me to use my new name (new middle name and surname) and just asking for marriage certificate and not asking for any legal documents about changing my name :(. Thank you guys in advance.

Did you make a Report of Marriage Contracted Abroad at the Philippine Consulate in your area?

You would need that so you can also change the name (use your hubby's surname) on your Philippine passport.

When we got married, Chinook immediately started using her new name. Her new name is Pinoy style: she uses her maiden last name as her new middle name, and she uses my last name as her new last name. She did not have any problems changing to her new name at the Social Security office. She didn't have any problems anywhere with her new name. We live in Washington state.

By the way, Chinook's new name does not appear anywhere on our marriage certificate except where she signed it. However, her signature is not legible.

Also, we never reported our marriage to the Philippines Consulate because Chinook did not want to amend or renew her Philippines passport. She now uses her U.S. passport.

The Report of Marriage Contracted Abroad is not only for the wife's name change on her Philippine passport. It is done so your marriage will be properly recorded in the Philippines' National Statistics Office (NSO).

A marriage where one or both of the contracting parties is a Filipino citizen must be reported to the Consulate in order for the said marriage to be properly registered and recorded with the Office of the Civil Registrar General in Manila.

Who is requiring you to submit the "court order"? Is it USCIS? IMO, they should know by now how Filipino wives change their surnames. :unsure:

It happened to me in my marriage. My husband change my Middle name from father family name to mother maiden name. In our Marriage Report I used my Mother maiden name even in my SSN and in my GC. When i Renew my Philippine Passport in Chicago the Philippine Vice Consul did not allow me to change my middle name from father family name to mother maiden name for the reason that I am a Filipino Citizen not an American Citizen. So, I used the family name of my father. Now, for safe travel anywhere the Philippine Vice Consul issued me a CERTIFICATION that Name bearing the mother maiden name and the father family name " ARE ONE AND THE SAME PERSON " In short I have 2 Middle Name. My Philippine Passport Middle Name is from my father and My Green Card Middle Name is from my Mother. . Its up to you if you will change your name in other documents but not in Philippine Passport. No Problem if you are an American Citizen... GO FOR IT...

from day one married use married name on all documents and when time to report marriage and renew passport and to SSN office everything is consistent. We had some hassle at biometrics. When you travel back to Philippines bring marriage license(not photo copy). Its all same as being married before just more steps and papers

^^^ Why don't you simply start using the name you want to use? That's what Chinook did. Chinook's U.S. passport, both of her old green cards, her state driver license, her Social Security card, and everything else all have her new name on them...Pinoy style!

^^^ Agreed. If you want to have your marriage recorded at the NSO, you need to register it with the Philippines Consulate. :thumbs:

However, Chinook and I don't care whether or not our marriage is recorded at the NSO.

our atty.. this is why i dont like having atty... for AOS its confusing :P, that's what i did in my SS Card pinoy style.. somehow they said that SSA thought that my family name is a part of my new surname which is not .. since when i go to SSA to change the wrong middle name they put .. i clearly said that my family name before i get married will be my middle name and my husband name will be my new surname and the SS officer repeat that for me and no objection about it. The atty want me to choose wether i put my old family name together with my huband name as my new name (means i got two surname) or just simple use my husband name .. (since they said i cant change my middle name and i can only change my surname.. It doesnt make sense)what about my effing old family name that i want to turn out as my middle name .. argg confusing .. :P

my thing is, if there is some law here in my state about not allowing someone to change the middle name after getting married .. and if u want u need a court order for that SSA for sure is aware about it and wont allowed me to put my new middle name in my SS Card.

so anyways .. coz i just want to make sure everthing is legal before I file my AOS with the right name .. :P i called local circuit court .. and asked about if i need a court order to change my legal name .. (due to marriage) and they said yes i have to file name change for that and a court order and it takes atleast two week for approval .. well i dont have a choice.. hhehe atleast now I got a peace of mind .. thank you guys for replying

Hi Sis!

I am in the same dilemma right now. My husband and I got married at NY. When we filed for our marriage license two months ago, the secretary only asked me what surname will I use upon marriage. I gave my fiancé's (then) last name as the surname I will be using. Then we explained to her that we want my middle name to be changed to my maiden name as the Filipino conventional way of naming when a Filipina gets married but she said they don't allow that. I will need a court order for that.

I am very bothered about it so we went back again to their office to clarify my situation. Still we got the same answer. They would NOT allow us. She just gave us the number of the county supreme court to inquire about name change. When we called the court, they wanted to know my status to see if I am allowed to do a name change. The K1 status filing for an AOS is not a concrete status for them so they asked us to call USCIS. I called USCIS but the person who took my query was of no help.

Now we are running out of time since we only have a little more of 3 weeks before my I-94 expires and we want to file the AOS as soon as possible. I don't want my IDs, documents not having the same name so I will stick to the legal name I am supposed to have here: FirstName OriginalMiddleName Husband'sLastName. I will just have to deal with the renewal of my Philippine passport before the year ends (it will expire by Feb of next year) and just file for an Affidavit of One and the Same Person. I will do a Legal Name Change when my GC comes and change everything to the Filipino conventional way of naming. Talk about enough stress I can't handle anymore. LOL I want to have a good, deep sleep. This is making me and my husband insane... :bonk:

I am wondering though how you did it. I couldn't risk putting my name the way I want it : FirstName MaidenName Husband'sSurname as I have read from others experience that they might have gotten through with the SSA but then when they had their interview for the AOS, the IO changed it back to the legal way of naming and some had trouble with the DMV too because they won't allow a different middle name (maiden name) but the legal middle name. They will ask for a court order as proof before they allow you.
