Hi Everyone,

My husband and I filed for AOS (from K-1) and our Paperwork was received by USCIS October 19, 2012. My Biometrics was completed November 23, 2012. We haven't had an RFE yet nor did we get a letter stating that our case was transferred anywhere. My EAD showed up last week.

Since our case wasn't transferred, Is there a greater possibility we will be interviewed?

Please advise.

I don't think that you will get an interview, it happens very seldom. We went through the process and smooth as butter. I think that all you will have to do is just wait......and wait, eventually if you have filed everything correctly you should be okay.

the uscis received our AOS on the 10/25,we had the biometrics on 12/04 and till now there is no new update,

I been reading a lot for the AOS processing.

most the case's that has been transferred has got update shortly after the acceptance and some before the biometrics and some after the biometrics in few days,

most case's with interview toke 2 months or more after the biometrics been taking,

so I guess you will be interviewed,it's just guessing tho.and I hope we get interview for our case.its faster than the case transferred

Nobody knows what the actual statistics are, but I think "very seldom" is stretching it. My wife and I had an AOS interview, and I know there are other VJ members who entered with a K1 and had an AOS interview. It may depend on random chance. It may depend on how busy your local USCIS field office is. I know that in some cases they find something in the case file that warrants an interview. We've seen cases transferred to CSC, and then some months later they are suddenly transferred to the local field office for an interview.

In our case, we had no RFE's or problems at the I-129F petition stage, and my wife's visa interview was surprisingly easy (only four questions), which is unusual for the consulate in HCMC, so we're pretty sure our AOS interview was not the result of anything in our case file. The AOS interview itself was friendly and fast.

It's ok to hope you won't have an AOS interview, but it's best to presume that you might.

When we did our AOS, I noticed a trend at the USCIS that more of the members on VJ had an interview than did not. That was back in 2011 so who knows now. I did not care one way or the other, I just wanted the process done so we could be on with our lives and not have to worry about the USCIS for 21 months. The drive across town to the interview took longer than the interview itself. It seems that processing times for those with interviews is faster than those transfered especially if the transfer is to VSC or CSC. I would look at your local field office and see what their timeline is for AOS and that might give you an idea of whether you will have an interview or not.

Are you able to access your case status online? If so it should display where you case is currently being processed. If its still showing the NBC (national benefits center) and youre an Oct filer, IMO, moire then likely youre not going to have an interview, as if you check the Oct filers thread - http://www.visajourney.com/forums/topic/394878-october-2012-aos-filers/

Youll see that most of the Oct filers who were selected for interviews already had their cases transferred and have received interview dates. Some have already even went for interviews or are going in the coming weeks. BIG disclaimer- doesnt mean you wont be transferred and have an interview, just IMO its not likely if you havent been transferred yet, just based on the trends of others who have filed at the same time.

If you cant access your case online call the 800 number and ask where youre currently being processed. If youre not at the NBC, then you were selected for an interview and you just have to sit back and wait until you get the interview notice.

When cases used to be transferred to the CSC, it was a fairly good indicator that you would have no interview. Since they stopped transferring cases to the CSC back in August, it has become harder to guess whether you will have an interview or not. It was never a guarantee even when sent to the CSC though. Ours was one of the cases transferred there and then transferred back to our local office for an interview.

Now, they either stay at the NBC and are approved without interview, or sent to your local office for an interview. All you can do is follow the timelines of those that applied around the same time as you did to guesstimate if you will interview or not, and how long it will take you to get an approval.
