Hi everyone

i tried entering USA on the 1st March 2012 and was denied entry and sent back to the UK. i had previously had a j1 visa and worked there and left when i was meant to. i returned home to the uk for a year and returned on a Q1 visa. After 10 months of employment i was terminated along with a group of others even when it wasn't my fault. I knew i had to leave the country as soon as possible but did not have the funds to pay for a ticket. i 'overstayed' 49 days and returned to the uk as soon as i could and made sure it was before my original visa was due to expire.

i tried to enter the NYC on the 1 March 2012 and was stopped. they wrote the numbers and letters 212 (a)(7)(A)(i)(I) 'inadmissible' ion my documents etc. Want exactly does this mean? i would love to be able to return to USA for pleasure purposes to see the friends i made over the 2 years i was there but i was told i had to apply for a visa. i got in touch with an immigration lawyer who told me my case was straight forward and she applied for a B! visa for me. when i got to the embassy for my interview i was told No almost immediately. the interview lasted about 2 minutes. i was devastated. after researching and reading up on stuff i now know i need to obtain a waiver of inadmissibility. which one do i need to apply for? how much does it cost? Im currently in the UK so where do i apply for it? also do i need to get this before i lodge an application for a B1 visa? or if i just want to visit my friends for a couple of weeks what do i need to get and apply for? how long do the applications usually take? Will i be able to fill out the application by myself or is it highly sensitive and need expert eyes to do it? Will this fix my situation for further visits to the USA??

please help me if you know any of these answers. USA is a big part of my life and teh thought of not getting back kills me :(

(A) Immigrants.-

(i) In general.-Except as otherwise specifically provided in this Act, any immigrant at the time of application for admission-

(I) who is not in possession of a valid unexpired immigrant visa, reentry permit, border crossing identification card, or other valid entry document required by this Act, and a valid unexpired passport, or other suitable travel document, or document of identity and nationality if such document is required under the regulations issued by the Attorney General under section 211(a) , or

This means that the immigration officers believed that you were an intending immigrant with no proper immigrant documentation.

thanks for your help but which waivers of inadmissibility do i need to apply for?

I 601 waivers are available only to spouses of US citizens and residents. The waiver gives you an opportunity to show an extreme hardship that would be brought on your American family. By those codes it looks like they have you as an illegal entry? I am not really sure about the entire situation, but you may be able to appeal or use methods other than waivers.

looks like you have a 3 year ban for overstay of less than 180 days. At POE they must have seen that you overstayed the 49 days. There is no waiver for you, the only thing to do is wait out the 3 year ban.

hi who do i contact once i have done my three year ban to make sure i can get back in? or who can i contact to appeal what happened to me? i just want to go back for a holiday to visit friends thats all :( i only overstayed 49 days and it was by mistake surely there is something i can do??
