Hello there fellow VJers..

Well, I have read and read and read and it seems the more I read more posts I get more and more confused. It is clear that everyone that filed an I-130 that resided in California had to send the paperwork to Phoenix, AZ (Which I sent to on 9/11/12) which was then sent to the USCIS California Service Center in Laguna Niguel (NOA1 on 9/12/12). Then a few days later it was transffered to USCIS-NBC, Lee's Summit, MO (NOA1 on 9/20/12). After that I haven't heard anything... I know the case was sent to NBC to relieve the loads at the USCIS office. But I have read on several posts that after they were transffered to NBC that it was sent back to the local USCIS office. So what I am confused on is the following:

  1. Does that mean something is going on with my I-130 because I haven't heard from no one (via mail, email or text)?
  2. Should my case be transffered back to the USCIS Laguna Niguel Office?
  3. If my case/I-130 was going to be transffered back from NBC wouldn't it be to the USCIS office that is closer to me (Which is the Santa Ana Office)?
  4. What is the average time for me to get the NOA2 approving my I-130 (Timeline said December now it changed from Feb to March)?
  5. Should my time line show I filed at CSC or NBC (So that timeline is more accurate)?

Thanks in advance for the clarification on my confussion...

First a clarification: Service Center does not equal field office. So your case was first sent to the California Service Center since it has jurisdiction over your area but then it was transferred to NBC to help with work load. NBC might then transfer your case to the local field office that has jurisdiction over your area. Someone living in Virginia would have had their case first sent to the Vermont Service Center and then transferred to NBC and then maybe transferred to the Washington field office.

1. No, you won't hear from them unless you get an RFE or when you're approved, are you checking your case status online? http://www.uscis.gov/portal/site/uscis input your case number in the top left, you'll be able to track you case that way. Also, you can make an account and set it up to receive email and/or text notifications whenever there is an update to your case.

2. That's not something we can answer, no one knows why cases are transferred to field office since some cases are approved at NBC and some at the field office.

3. Go here: https://egov.uscis.gov/crisgwi/go?action=offices.type&OfficeLocator.office_type=LO and input your zip code at the bottom, that will give you your field office. That is where your case will go if NBC transfers it to a field office.

4. Were not really sure about average time b/c it depends on if you're transferred to a field office and each office has different processing times that are not published.

5. It should show NBC although NBC only just started accepting cases on Aug 15 so I wouldn't count on the information on your timeline, and you also have to factor in the chance that you might get transferred to a field office. But you're not being processed by CSC so you're skewing their data by listing yourself as CSC. ;)

Have you called USCIS to speak with an ISO (tier 2) and see if they have any more information?

Sometimes they are able to tell you if you've been transferred to a field office.

Also, perhaps you were sent an RFE and it got lost in the mail?

After this amount of time, you should definitely consider calling just to see how things are currently sitting.
