Hi,

I am almost done completing my forms to be sent in, by have a few questions.

Here is my situation. I was married to my husband (US Citizen) about a year ago (here in the US) and have been living in the US with him since about a year ago.

We are filing concurrently an AOS and Petition for Alien Relative concurrently.

Question 1:

Do I need to complete separate form (whatever), Biograpghical info sheets for each application?

Question 2:

We are requesting a fee waiver. Do we need to complete separate fee waivers for each application?

Question 3:

It's a bit confusing about where to send the forms. I believe I am correct in thinking both appplications should be sent together to the Chicago office (from the info send from USCIS it appears one needs to go to Chicago and one to Vermont). Can someone advise me on where to send in concurrent applications?

If anyone can help me out here, it would be greatly appreciated.

Sorry one more question:

I think I saw somewhere that you don't need to send in certified copies of b/c, passprt, marriage certificates etc, however USCIS has redesigned their site and I can no longer find that information.

Is it ok to send in simple photocopies or do I need to bring them to a notary?

06/01/2009- Received Biometrics Letter

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

Hello,

Sorry to be a pain but can you tell us your current status?

Are you currently legal in the USA?

What VISA did you enter on (K-1/K3)?

Sorry if it seems harsh but depending on your current status the advise will differ drastically.

Maybe i'm being dumb and missing something but the wording doesn't imply you have a VISA at the moment.

Sorry missed the part about being legal. I entered legally if that is what you are asking, as I am Canadian, I didn't need an actual visa to enter. I'm not sure if I would be considered illegal because I have been here for more than 6 months or not. Anyways, I am living here with my husband, we've decided that I should stay here with him (was intending to return to Canada for a bit) and want to adjust my status in order to get on with things.

Q1: You need to provide supporting documentation as called for in the instructions for each 'whatever' form.

Q2: It will be interesting to know how you are going to be able to justify a fee waiver while meeting the sponsorship requirements of I-864, but I have read of a person who managed to accomplish it (I don't know how).

Q3: The forms go to the Chigaco Lockbox, the receiving station of the National Benefits Center.

Well, it was quite the process, but I think I have a good case to support that we are currently too poor to pay the AOS/ I-130 fees (cause we are), despite my husband making enough to meet the sponsorship qualifications.

Hopefully it is approved!
