We received a letter requesting for evidence about the affidavit of support that says the income did not meet 125% (or 100% for active duty military)of the federal poverty line for the petitioner/sponsor's household size.

My husband is a reserved ACTIVE military so we fall in 100% poverty guideline (Unless they didn't see and count him as an ACTIVE MILITARY) His income was more than the poverty guideline for 2 people so we didn't put other assets. Now they are requesting for assets. We are just confuse how come we didn't meet the poverty line if his previous 3 years tax income was above the minimum guideline? And How much should we add for the assets to meet the guideline if we're beyond it?

Help please.

Military Reserve means - Armed forces that are not on active duty but can be called in an emergency.

Oh okay. cos we thought that active reserve is also considered active duty. so that's our problem. Which do you prefer to do? Send an asset or get a joint sponsor? We are 2k under the 125% guideline if we have 5k in our bank account should it be enough? We are worried that they might ask for another RFE so we want to make sure we are sending right documents.

It depends what assessets you have. I used my wife's mother as a joint sponsor as she earns $85,000 a year.

he's at home. he is also self employed. hmm.. sounds like a joint sponsor is the safest thing to do?

We only have our bank account and 2 cars. Im not sure if its enough.
