I'm from sweden and I'm here in America as a visitor under the Visa Waivor Program for 90 days. My american boyfriend proposed to me and now we're getting married within my 90 days here. We want to have a church wedding and because the holidays are coming up we want to wait to get married till January 6th. My authorized stay expires january 14th.

The problem is that it appearently takes time before we get our marriage license. Is it possible for us to get our license and send the applications ( i-130 and i-485) to chicago before january 14th, when we're getting married on the 6th? How do you suggest we do? Is there any other way? (except for getting married sooner...)

Can we wait till we get the marriage license and send everything then, even though it's going to be after my authorized stay?

you get married first..... then you can go home and file for K3 or you can go home and file for K1 then come back and get married once approved.....

did you intent to get married and remain when you entered the US or did you intend to return?

As I said, I came here as a visitor and dit not expect my boyfriend to propose to me. I have a return ticket and everything and didn't plan to stay at all. I guess the idea of me applying for a visa in sweden, and the time that takes, was more than he could handle so he asked me to marry him and stay if I could. The reason we want to apply from america is because then we don't have to be apart anymore than we've already been. I know we can apply from here (after many hours reading... didn't know people could do that). It's just the licence that's an issue.

If you are married to a US citizen and overstayed your VISA (out of status), then apply for the immigration benefits you mentioned, from within the US, your overstay won't matter.

If you overstay your visa by a certain period of time and then leave the US and try to come back, that is a different story. I'm too lazy to post up the actual information from USCIS, but it can be found with an internet search.

I don't know how long it takes to get a marriage certificate where you live, I think it was under 2 weeks from my marriage where I live here in Massachusetts (i waited 6 months to get mine though, cause i didn't need it).

02/09/2005-------Sent in request to Congressional office for assistance with expediting EAD.

02/13/2007 -------- EAD Approved!

02/26/2007 - ------EAD received

Removal of Conditions:

05/12/2009 -- Overnighted application by USPS express mail (VSC).

05/14/2009 -- Green Card expired.

05/23/2009 --- Check cleared bank.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.
