Hi,

I recently got married to my wife in December 2012 in India. Im a US citizen, and she is here on a H1B. We found out while getting ready to file I130 (Spouse) that there was a name mismatch between her passport/H1B forms and Birth/Marriage Certificate.

Passport : <first name> <middle name> <Last name>

Birth Certificate : <first name> <middle name>

Marriage Certificate : <first name> <middle name>

What Is the best way to proceed with this? What are the options available in this situation?

How much time does she have left on her H1-B? If she has enough time, is it possible for your to update/amend the birth/marriage certificate? Seems like you want to keep the name on passport.

i say use the passport name as the controlling name.

then, in the i-130 and the G-325A - check the 'other names used' sections.

don't forget, aye? when adjusting to this type of status, is best to file the I-130 with the I-485, at the same time.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.
