PLEASE HELP! I'm very confused.

Timeline

I came here with a K3 visa...and I have to adjust my status here for a imigrant visa. My question is: my aplication for I130 was aproved on january 1st this year...so I can file my AOS anytime...but I know that the petition I130 stays at NVC only one year...so I'm wondering " Can I send my AOS papers next year in february after we do our taxes? Because we want to be able to show that we can suport ourselves, cause for last year my husband worked only half a year so he won't be able to prove that he can suport me."

I'm afraid that we won't be albe to file AOS after december this year...and I won't be elegible for an imigrant visa if I will wait till february :(

My k3 visa is valid 2 years...but I dunno when to aply for AOS...

I'm so confused...please...someone ...HELP :help:

You did not have to wait for the I-130 petition to be approved to apply for adjustment.

The Sponsor (or a Joint Sponsor) needs to have a current income that on an annualized basis meets the income requirement, they do not need to have worked for a year and have accumulated the required amount of income. Income history does play a role, but you have not provided enough information about your husband's circumstances to know if his history might be positive, negative, or neutral.

Without knowing more I don't see why you shouldn't submit your I-485 right away. (Did you tell the NVC that you planned to adjust status when you sent them your DS-3032 Choice of Address and Agent?)
