QUESTION ABOUT CSC TRANSFERS

Helloooo,

well, I have a question:

By reading a few of your guys' post, I came to the conclusion that people that entered the US on a K1 visa are pretty much all getting transferred to CSC-

is that true?

Also, does the file usually get transferred before or after an RFE?or can it happen either way?

One more thing- when I got my RFE it said that once the missing documents(which werent really missing documents since we already submitted them once before) are received by USCIS, it'll take another 90days to process my employment Authorization- is that true?

My receipt notice was 8/04/06, so I thought I should be getting at least the work permit.

Does the processing of AOS have anything to do with the work permit- in the matter of- if they say that something else is missing (or got lost) and send me another RFE, will that delay(again) the approval of my work permit?

12/28/2006 GREENCARD ARRIVED IN MAIL PERMANENT RESIDENT SINCE 12/19/2006!!! (DAY 49 AFTER RFE submitted) 153 days total

Okay I will try my best to answer your questions ...

It doesn't seem to be all of the K-1s ... But it does appear to be K-1s whos local offices are backlogged but we haven't really come up with a common thing ...

Also, does the file usually get transferred before or after an RFE?or can it happen either way?

It is my understanding that when you send your paperwork to Chicago it is reviewed, sorted and then they process the payments ... (Not 100% sure if they do any real detailed check for documents or jsut leave that to MSC) ...

Then your file is forwarded to Missouri Service Center (MSC) where I believe they also do a check to see if anything is missing ... I believe this is what they call the initial check ... If they feel something is missing they will send out a RFE ... If you receive a RFE at this point then this is where your EAD can be delayed ...

After they feel everything is there (or receive the info from your RFE) they will then forward your case to your local office ... Or for the K-1er they may choose to forward these on to CSC ...

It appears from your RFE that it was the initial review of your case so yes this could delay your EAD ... If you receive a RFE later in the process then it is my understanding that your EAD is frozen until they receive your RFE then it proceeds as normal ... So basically if you receive a RFE at say 60 days then your EAD stay at 60 days then when they receive your RFE they would have only 30 more days to approve your EAD ...

Your NOA1 date was August 4 ?? and when did you return your RFE info ??

I entered USA as a K-1 and have just got my interview appoitment - I guess it means that I was NOT transferred to CSC.
