Yea, that is one thing I value regarding Enlightenment thinking and that is separation of church and state. I respect others religious opinions to the point where it impacts me personally. I feared it would directly impact me and that was the cause for concern.

Your overthinking reminded me a lot of my husband's thoughts and concerns before we got married, hahaha! Ours was a different issue, but I actually admire you for being able to say what you're really thinking.

I suggest you focus on the facts at hand. If you find out (as you already are doing) that you can't easily be out of a marriage if it was in the Philippines, will that actually matter on whether you marry your fiancee or not? If it's very important to you that you can still get divorced, strive to apply for a K-1 visa then. Just don't tell your fiancee that that is your primary reason for pursuing K-1. I must admit women are overly dramatic sometimes *guilty*

As for bastards, well, I used the term because my girl friend's ex husband was a substance-addicted, irresponsible #######. However, for the women, it wasn't so much as them being money grabbers, they were, surprise surprise, philanderers. :-/

Ivy...yea, the I-864 is something that a good lawyer could probably tear through, but precedents have been set, so unless you have a shark lawyer who knows the judge really well, it could be a nightmare and it definitely could be appealed up to the Supreme Court even. Having weighed everything, I am not worried about it anymore and plan to marry in the Phils. We're making our pig plans now...lol...how many pigs to buy? It's good to be worrying about these types of things instead of the shackles of laws. Thanks for your input...

Well I was about to say... I thought they just passed a law allowing divorces in Philippines.. but I guess it's still in the works (pending). Anyone heard any news on this? (not that I really care)

There are a few cases of Filipinas who murdered their Americano husbands, one of whom cooked various body parts and ate them. She said the ribs were the best.

I believe this is your worst case scenario.

There have been politicians saying they want divorce legal in the Philippines for a long time, and have introduced bills many times to. Its not likely to get much traction, and even if it does, it runs counter to their constitution in the opinion of many there. "Article XV Section 2. Marriage, as an inviolable social institution, is the foundation of the family and shall be protected by the State." My wife, a Philippines Citizen, who is normally pretty liberal in her political views, thinks there is no need for divorce when they already have annulment available. And calls the Gabriela party is crazy to even bring it up.

Don't forget about buying cows to roast, too :P

Artificial contraception was a hot topic for almost a decade and have only recently been nationally passed into law. Divorce in the Philippines... I will be shocked if it will happen before I have grandkids. Tsk tsk

I was surprised at the cost of a pig...almost $400 for a large one....

Artificial contraception...hmmmm...that is saying something though because that is really anti-catholic....really, anti-christian...i have a born again christian cousin who is preacher who would never allow this if he were the law...there is a saying in US that you never discuss politics and religion in a bar because it always leads to a fight....I can only imagine what it must be like in phils government dealing with these issues...

Also as far as I know, IF the USC is the one who applies for a divorce, the Ph citizen is allowed to remarry right?

Yes, but to remarry in the Philippines or have a remarriage elsewhere recognized in the Philippines, there is a court process to go through where they verify the divorce was properly done by the laws in the location it took place. Then that finding from the court must be turned into the NSO.

you can get a divorce in the USA. the 10 years is now long the I-864 will be in effect. even if you divorce after 3 years. you'll still be on the hook for 7 more years, unless she's become a citizen or returns to the Philippines.

It's not only for ten years. It's until they worked for 10 years (40 quarters). If they don't work, you're on the hook for even longer.

As somebody pointed out, one has to pay in to social security/medicare for 10 years. So when I said working, it's assuming one has worked in the US in a legal position (not being paid under the table), and thus having payroll tax withheld and paid into the SSA on their bahalf.

Worst case scenario is they deny your application after years and years of waiting and you end up living in the philippines.
