Hello everyone!

I'm an US Citizen (born in NY) raised in Dominican Republic (lived there for almost 25 years). I met my fiancee in DR 3 years ago; she is an Spaniard with dual citizenship (Spain-DR: Her mother is Dominican, but she was born on Spain) who is currently working and living there.

On Feb. 2012 i got a job in the US and decided to move, leaving my girlfriend in DR with the promise we would get married.

We finally initiated the K1 Visa Process after we gathered every document needed. As of today (1/14/13) we only have received NOA1 (Received on august 6, 2012). We are estimating still 2 to 4 months to finally get the interview at the US Embassy at Dominican Republic, and after that we are hoping the be married in less than 1 month. After all of that we would still need to wait from 1 to 3 months to finally get the work permit for her; wich is our ultimate goal. Being realistic we are looking around 4 to 7 months until our goal of getting her EAD.

I recently learned the possibility of the Direct Consular Filing (DCF) wich would gives us the opportunity of getting her green card (no need for EAD) in less time.

Please help me with the following questions:

1. Can we apply for DCF, even tho im not currently living in DR, but i have all the proof i have lived there for more time than the 6 months required?

2. Do i have to be present at the DR during all the filing process? Or can i make arranges to be present only during the interviews?

3. Since we are not still married i would proceed to do so, but can we submit the paperwork with less than a month married?

4. Since she has dual citizenship we decided to make the K1 petition as Spaniard; is there any difference regarding that matter in DCF?

5. Knowing the above, does it makes sense to even attempt to proceed with the DCF, leaving behind the K1 process? Even when we have spent a lot of time in the process, our estimated time to end the process is longer. We would like to know our possibilities before spending more time and money.

I know its not certain that they even do DCF at Dominican Republic, but i wanted to make sure i could even apply to begin any action.

To demonstrate residency in a consular district, American Citizen petitioners must be able to show that they have permission to reside in the consular district and that they have been doing so continuously for at least six months before filing the petition.

That will not work, you need to be living there currently.

I would continue with the K-1 and just wait it out. Re-starting would be a waste of time and money in my opinion.

3. Since we are not still married i would proceed to do so, but can we submit the paperwork with less than a month married? This is a waste of money if from what I'm seeing in your timeline you already filed for k1 continue that rout you almost done

4. Since she has dual citizenship we decided to make the K1 petition as Spaniard; is there any difference regarding that matter in DCF?You are confused about the whole DCF you should research more into.

In my personal opinion I would continue with the K-1, Re-starting would be a waste of time and money in my opinion you came this far you at almost at the finish line, you just got about month or so to go before your case gets approved. I'd be you I'm cross this possible decision off my list, and stay where you are now! Good luck on your journey.
