I'm refiling.

Thanks for the help and clarification and notes from Dean and mtc.

Life would be too boring if we were all perfect.

read the guides.. every day.. read the post in the K1 section .. see what mistakes OTHERS are making.. look at the part of the form they are talking about.. so YOU don't make the same mistake..

the more familiar you are with the forms.. the less chance of mistakes.. take your time.. be patient.. no matter when you submit.. its still going to take 9-12months (yes there are others have got it sooner.. but don't get hopes too high.. its less stressful that way

..

so sending out application.. as accurate will just make sure it follows path for approval as it is supposed to :)

good luck! :)

When I was filling out my applications I went through the instruction document, word for word, and highlighted each and every action item. Then I started at the first highlight, gathered that information, and crossed it off. I then went to the next item and did exactly the same thing until I'd gone through the entire list. Read carefully; note the action items. It leaves very little room for error. Good luck with this one. :)

When I initially applied, USCIS lost one of my forms and the petition was denied, however they sent everything they had back along with the uncashed check. I am surprised they took your money with an incomplete package....

actually I am surprised they sent you your check unchashed..maybe it depends on which form they lost. I know two friends personally who did not include their birth certificates and were denied. Both their checks were cashed. One of them appealed(despite my advice) and its been over one year since she did that without any feedback from USCIS on the case. Now she is thinking of reapplying.

oh they both petitioned for their mothers ( hence the birth certificate requirement from petitioner)

Words mean things. Your petition was "rejected" not "denied". You didn't apply for anything. You filed a petition. When a petition is denied, they keep the filing fee because it is a fee for filing, not a purchase price for a product.
