I didn't send in the G-325A for either of us. Unfortunately I found this site after I filed and did not 'see it'.

However, I looked at the uscis.gov site and could not find where it is sated to include the 325A with the 129F.

Should I re-submit everything with the appeal or just the G-325As?

...have a very sick feeling right now....

Hi! Just to give you an insight, my fiance sent G325A for both of us, originally signed, Letter of intent to marry w/in 90 days upon admission to the US, originally signed as well, form 129F, emails, chat logs (any conversations logs w/in the last 2 years, 25-30 pages), photocopy of his passport with the stamp when u visited, copy of plane tickets, photocopy of ur birth certificate, any bank/credit card charges when you were with her. Those were the documents he sent to the USCIS. It is very important to write on the 129F form how you and your fiancee met and establish the relationship. I hope this would help :) Good luck!

im wrong i went back to read it and u all are right it does say send in evidence and a letter im sorry

Thank you. I wish we would see more people more often simply say "Oops, I stand corrected" instead of 6 pages of trying to justify their error and confusing members looking for help. We all started at -0- and we all made mistakes.

When I applied I read EVERYTHING and then sent Everything. In a beautiful indexed 3 ring binder. It all came back within the week all reasembled. I had forgoten the their check !

Sent it the next day and never lost my place in line. Stupid mistake but we are all human.

This is called a "rejection" and is not bad. You get it back quickly and can correct the error and get right back at it. Had the OP forgot to include a check or forgot to sign a form, the petition would have been rejected in 2 weeks or less.

When it is "accepted for processing" that does not mean anyone has checked it for completeness. They checked the signatures and cashed the check and then it got stuffed in a box with all the others and waited until someone pulled it out and decided there was not enough to even send an RFE

Is it a perfect system? HECK NO! But y'all complain already about it taking too long and, nothing personal to the OP, but this is a big reason why. There are thousands of petitions in front of yours, taking their time, filling in space that should not even be there because someone did not read the instructions. An appeal would put these BACK in line ahead of YOU (everyone else)

That would not work at the bank, the grocery store or the post office and it does not work for USCIS. Be aware, if anything goes wrong in this process (and the I-129f is just the tip of the iceberg) it is YOUR problem

REALLY? Good to know.

Since Baron and I have wives of similar cultures and fairly similar in age I can say what he says is true, at least of FSU women. I think it also runs true for the foreign beneficiary who is rightfully looking for his/her US citizen fiance(e) to take the lead on this.

Now if I had said to my wife (fiancee) "I am not sure about this, I want to hire someone to help us so we do it right" I would get a +1 for thinking of her and being willing to pay someone for this without asking...handling it. BUT when I said, "Look, I want to take a little time to study this, learn about it, because it is a long process and we are not going to be running to an attorney every few days. This is my family and for now and forever I want to KNOW how to care for them best" THAT gets a +30000000000000 I postponed our filing for 4 months but then got it right all the way through citizenship, I still get the +3000000000

If I had sent in an I-129 and had it denied a year later because I did not read the instructions, she would RUN! And that's a fact. A FACT. She had herself and 2 children and the future of her mother and even her dog and cat at stake and if the man she chose could not read the instructions for the most important people in his life....um, well,NO!

Baron's advice is sound and advisable for anyone with a foreign spouse. They are the most important people in the world and you owe it to them to learn what you are doing. It is going to be part of your life for a long time

I just called the USCIS again. I can send in the appeal (Form I-290B) along with the additional information.

This is all my fault.

Listen to experience. The appeal will prolong the whole process.

File a new petition, and submit EVERYTHING this time. You have to prove everything you state. Read the guides here before submitting.

Good luck...

this is just not right!
Gary's post (#50, just a couple above yours) adds some crucial context to the seemingly not-right quote.

At any rate, the OP has the firm answer to refile.

Edited by TBoneTX

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Well we might just go so far as to die for each other, so a simple mistake like forgetting to include the G325a s would be water under the bridge, don't you agree Gary?

Not at all.

Such devotion is important between a MAN and a WIFE. Our (mine and my wife's) current relationship. There are things to consider BEFORE reaching that point of devotion and BEFORE entering into that relationship, unless you are suggesting we choose a mate for life randomly.

I am trying to imagine telling Alla this after a year of waiting. "I forgot to read the instructions...I feel foolish" Fortunately, as someone who WOULD die for my (now) wife, I DID take the time to learn the process BEFORE entering into it, because, well, that is just a whole lot easier than say, dying. Don't you agree, Nola?

As a finacee (woman) with children considering giving up a very good life and business to move half way 'round the world for a man, and if his "simple mistake" was to not even read the instructions for the documents necessary for us to get married...then YES she would have never entered into a relationship she would be willing to die for. She would be STUPID to do that when she already had made a good situation for herself and children. But that is just my wife (former fiancee). Maybe others do not care.

Personally I hope things work out for the OP. I know MY point was to impress that this is important stuff and should be approached carefully and thoughtfully...not in a big damn hurry. It would also be nice if the OP would have gotten off the "What can I do now...quickly" train. There seems to be a whole lot of interest in doing something QUICK, which was the problem to begin with. Just sayin'

Someone else is depending on him, someone else SHOULD depend on him and should be ABLE to depend on him. That's part of being married, part of being devoted and more important than, say, sex, or something else silly.

More succintly...there is no "bridge" yet for water to pass under. There would be, but someone needs to read the instructions in the erector set.

When I initially applied, USCIS lost one of my forms and the petition was denied, however they sent everything they had back along with the uncashed check. I am surprised they took your money with an incomplete package....
