Can I add my daughter to an approved I-130

I have filed an I-130 for my husband. (I was thinking of filing I-129F so that i could add my daughter and get her k3 Visa), but before filing for in I-129F my husbands I-130 has been approved. My daughter was 6 months old when I filed for an I-130. Can I still add her?

I actually filed an N600k For my daughter, everything went smooth with the process we even got an appointment date for the Oath taking. But the US CONSULATE in MANILA did not issue my daughter a non immigrant visa.(part of the N600k's requirement is that the child has to be in the US on a Non Immigrant Visa)... So the N600K got wasted all because of US Embassy Manila denied her of a visa.. now i'm faced with this problem.. . :(

any advice?

we couldnt get her CRBA because i did not meet the requirements of the 5 year physical presence in the US. we filed N600k instead we used Grandparent's physical presence. Everything went well with N600k. the problem was the us consulate in the philippines denied my daughter a Non immigrant visa to attend her oath taking for naturalization.

There are no derivatives in I-130 petitions - daughter will need a stand alone I-130.

if i file an I-130 for my daughter, is there any way i could get it expedited since my husband's I-130 has been approved already? So that they could come together?

Yes, im a USC. I did not meet the physical presence requirement of 5 years in the US. we tried to get her CRBA but wasnt able to pass that citizenship with my daughter.

Ahh, yes. Ok. Then once she enters as a LPR, she'll be considered a US citizen under The Child Citizenship Act of 2000 as long as she meets other criteria.

I don't believe you can expedite her application. You may be able under the first option, or the customer service rep might be able to use discretion on your new I-130 case.

See here for the normal list of reasons for expediting a request. But you MUST submit a new I-130 for her, and as sson as USCIS receives it, call in to see if you can have it expedited or send in the request with the application and state the reason fully. Explain how you thought she could go the N600k route, but was denied, so you needed to submit this application to get her permanent residency and citizenship under the Child Citizenship Act of 2000 and that she won't be able to come with her father.

She turned 1 two weeks ago.

Geez, its so painful for me to have to go thru these.i thought we would be done with all these hardships of separation.. i guess i need to file i-130 now.. $600 for the n600k was wasted. :(

She turned 1 two weeks ago.

I would submit for an expedite. Either way you have to submit the I-130. There's no way around it. So get on that first. Submit the paperwork and request for an expedite. They might be able to accommodate you, since she should not be separated from both her mother and father. It would be a great loss to her. She cannot support herself. Try it. There are never guarantees, but either way submit that I-130. Because there is no other way to bring her into the US.

NO. Children do not submit g-325 at all.

Yes. The parent (you) signs it in this case.

Petitioner LPR upgraded to USC June 22, 2012
August 22, 2012: case complete
October 18, 2012: Interview (APPROVED)
October 26, 2012: Picked up visa from DHL (delay caused by Sandy)
December 15, 2012: POE Atlanta....................became USC July 2016!!!!

Mothers' Journey (My sister is the petitioner)

September 10, 2013: Sent I-130 (UPS next day service)

September 12, 2013: Received text to confirm delivery

September 16, 2013: Received NOA 1

March 22, 2014: Received NOA 2

April 8, 2014: File Received by NVC

May 26, 2015: Interview (approved)..........now LPR (delays caused by 2 RFE)
