Ok any help would be great,,,

I came over from Scotland on vwp and married my with while it was still valid but now i have over stayed it as it ran out in Jume, I know I need to do the AOS but how can I show any proof of joint bank accounts etc if I can not get a social security number or is there a way I can get this before the AOS interview

Please help

The only way to open an account is to find a bank that might not be as picky in terms of identification. While it is really not a requirement to have a SSN: some banks do ask for it but there is really no law specifically about SSN; what the law says is to identify the account holder thus a passport should suffice, however, at that point they might want to see a valid visa and I-94 (yes, I know you don't have one, but it will depend on whether the bank employee knows how VWP operates); again it all depends on how savvy the bank employee is.

However, many banks would accept you as a joint holder in an existing account, with minimal identification and even leaving the SSN pending if you explain the situation.

As for AOS:

You can show other documents, such as lease in both names, credit cards with same number (but different names), etc. You want anything that shows both names in same address. You might want to get a couple of affidavits of people that know you both and can state that you are representing to be spouses and that live together.

Last but not least, it is not really expected that a lot of commingling has occurred at the AOS stage, so even if there is an interview, it would focus on how you met etc. But, if I were you, I'd expect an plan for a more thorough interview when you do ROC (assuming you would get a temporary GC out of AOS)
