Hello guys,

So I married my fiance on january 1st!

She is a US Green Card holder. I was a bit confused on the forms we need to send out. Should we send out I-485 along with I -130 and G-325A? Or does that come after the I-130 has been accepted?

Also, I assume we should send out all the evidence with I-130?

I am going back to school in the US until I receive the GC, if that makes any difference.

Thank you all so much, any advice is well appreciated.

Hi,

yes, I am already inside the U.S.

I saw this guide before posting, but still wasn't clear if this only applied to spouses of US citizens or Green card holders as well.

So we can include the I-485 package with the I-130 package?

My understanding from the USCIS website was that I'd need to first file I-130 and then if approved, proceed with the I-485.

Hi MisterEko, It is my understanding that you cannot adjust your status based on marriage with a LPN (green card holder). Your wife has to become a US citizen before you can file I-485.

I think you can file the I-130 petition in the meantime. But someone with more knowledge on the subject with certainly give you more insight. Best of luck on your journey.

Yes, if I understood correctly, I can only file I-130 for now, and when my number comes up in line, I can then file for the adjustment of status with I-485. I'd appreciate everyone's input.

When your spouse gets naturalized you can go ahead with the AOS application. You can also wait till she gets US citizenship and file everything concurrently.

Yep, as the spouse of a greencard holder you cannot just AOS, because you have a 2.5-ish year wait for your priority date.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

But once the priority date arrives, I can file for the adjustment?

And for right now, we only need to send in the I-130 and Affidavit of support I-864?

Thank you so much.
