My wife filed I-130 for me at March/2012. I have child of 2 years and have US Passport. I have faced the interview at 10th December at Dhaka Embassy, Bangladesh and they told me to go again with Child's Birth Certificate. They provide me a blue paper and did not mentioned any Date to go (told any day).

My name is not listed in the B.Certificate. My wife gave the paternity form signed by me at the hospital and also a notarize copy from me. But they did not list my name. One month ago (just after getting this refusal) she went at birth certificate office and submitted again. After one month they sent a letter that there is something error! She will go tomorrow to fix it. And will come Bangladesh with my child. By this time lat week she was diagnosed Brain Tumor and she wants me beside her during the surgery.

I have few question please.

If my wife comes and We go to the embassy, it will be about two months delay from the 1st Date (10th December). Will it be any problem for the delay??? I heard sometimes they send the file back to the USCIS? Is there any possibilities to send the file back to the USCIS in my case???

Is there any option to check the current situation or to confirm that they will take the interview(as that this is two months late)??

Will they notify me before sending the file back to the USCIS??

Nobody but a Consular officer can give you a definitive answer to your question. The case would only be sent back to USCIS if the Consular Immigrant Visa Unit decides to ultimately deny your visa. A delay will not cause the case to be sent back. Go plead your case together with as much documentation (including documenting your wife's medical condition) and see what happens. It's your best chance of being together soon.
