Hi,

I took two long trips out of the US - two 7 month trips (on the second trip I came back to the US for a month) - and then returned home to the US for 8 months. I left the US for the holidays from late November and will go back home to the US mid February.

To be safe, I have documentation of my ties to the US such as:

- Credit cards

- US address

- 2 bank accounts

- (Resident) tax returns

- Drivers licence

I ask because last time I had a rough time with secondary inspection. I think my greencard was flagged. This time I will have been out for 99 days, just over 3 months but want to have all those documents with me just in case.

Do you think this is enough to satisfy the CBP officer or do you think I will run into problems at the POE (Pre-clearance) and have to go to secondary inspection or worse?

you're probably going to have issues.

You need to LIVE in the US. Not just visit it.

02/01/2013: Interview scheduled

US Embassy Lagos

02/22/2013: Embassy received

03/01/2013: Medical

03/20/2013: Interview - was told the boys would have been approved on the spot if they had pics! Errrr :-(

04/15/2013: DNA test

05/15/2013: Emailed embassy BEGGING them to let boys drop off passports for visa insertion. IT WORKED!!!

05/31/2013: Visa in hand

06/02/2013: POE JFK!!!!!!

if you plan to be absent from the united states longer then one year it is advisable to first apply for a reentry permit form 1-131 to travel.advance parole,or show some evidence as to why you stayed outof the u.s so long due to circumstances beyond their control, i think there is a form ds-117 that you file at the embassy there but it takes time to process,

Thanks for the replies. I was thinking that because this trip has been around 100 days that I would probably be okay with the evidence above. I think secondary questioning is inevitable but I'm just hoping that it won't go further than that.

If I do have problems and they think I have given up LPR status, given that I go through pre-clearance, do they try to make me sign form I-407 or let me go through and tell me to go to a hearing?

ALso, if my greencard was "flagged" on the last trip, does that stay there forever?

For as long as you have your green card, it does. If you surmount your absences and eventually gain citizenship, you start afresh.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Thanks TBoneTX, thats good to know. Then given the fact that my card appears to be "flagged", despite being out a lot less than 180 days, will I be automatically sent to secondary questioning?
