Can I traveling while my E3 Visa is still pending?

Hi,

I am currently employed in California at a great fashion e-commerce company that sponsors my E-3 Visa. It has been pending and in evaluation for almost 6 months now and is currently at "Request for Evidence". Our company lawyered has turned in all possible documents to USCIS and we're waiting on the results. However, I just got an emergency family situation back at home in Taiwan, which I must go back for two weeks to visit my family whom I have not seen for 3 years. I must leave February 1st, which gives me less than 3 weeks for my pending status to complete.

Will I be able to leave United States and come back in two weeks and still keep my job and proceed my pending E3 status? This is a family emergency, I really have no choice, is there an exception? Can I provide any document to prove the urgency of this case? Please advice, I have candles burning on both ends.

What is your status now? Are you on an E3 visa and looking for a renewal? Or did you start working before it was approved?

I would not recommend leaving the country before you have a valid visa on which to re-enter, or you may find you can't get back in.
