finally received NOIR from uscis.The embassy wrongly accused my hubby of being married before because in the tourist visa application he lied that he was married and had a daughter.The truth remains that he was never married to anybody except me and had no daughter either.He told them during the interview that the marital status was made up based on the advise he received from the travelling agency who handled the application on line.He confidently signed a form that he wasn't married to anybody,yet it was returned.returning files based on assumptions?highly inconsiderate.

OK are you really this stupid? THEY DID NOT WRONGLY ACCUSE HIM OF ANYTHING!!!!!!!! He TOLD them he was married with a child. HE LIED, what do you not understand about this, SERIOUSLY? Just because someone gave him bad advice and he decided to follow it doesn't discount the fact that he LIED intentionally to immigration. If someone told him to jump off a bridge, would he? Nobody here is going to give you or your husband any sympathy. He lied to obtain a visa, plain and simple, he will have a lifetime ban for material misrepresentation. headbonk.gif

Point taken.It was a mess.my earlier post was based on what the embassy told us.Just found out the actual reason,blaming me at this point for that is not gonna help consindering my health and lack of communication from governmental agencies for a year.At least,the embassy was convinced he wasn`t married,they sat on the case for so long.He is not lieing now,am happy for that.he is honest.During the tourist visa interview,he was not asked any question.He was ready to tell the officer then that he was not married but it was denied without a single question.

point taken.he is honest now,am happy about that. Actually it didnt make sense,he lied.It was stupidity and ignorance.buh could this be the highest crime on earth?God is faithful

Material misrepresentation is a lifetime ban in order to dissuade other people from lying on applications and forms. The embassy makes the decision whether to grant someone a visa based on what is written in those forms and when someone lies they are making a decision based on false information. It is very serious and has nothing to do with God, I'm pretty sure it is very clear in the Bible that lying and giving false testimony is not a slight transgression.

The NOIR did not accuse him of material misrepresentation.It accused him of being married before without divorcing.

This is what we call a "Catch-22".

Your NOIR which you have 30 days to respond to with the evidence they require doesn't exist.

They are saying your husbands case was denied because he was married before and has produced no divorce papers.

He says he was never married and lied.

So you have to submit evidence that "oops husband lied there are no divorce papers cuz there wasn't a previous marriage".

Now you have a misrep.

You need to run not walk to a very good attorney.

I don't see a way out but who knows all things are possible.

What's a trip is if I posted this same story when people see the flag on my profile it would be like lions on a carcass. You should feel good you aren't be attacked like you married Jack the Ripper. Wish you all the best.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
