Good morning everyone,

Seems that we are becoming VJ junkies!!! Which is a good one, I think.

OK, so we are doing DCF through Montreal. Yesterday some folks in here told me it was ok to begin gathering the documents in advance, so as to be ready when packet 3 arrives from MTL. Goodie. Now, since DH is a foreign student in Canada (USC), his income -which mind you, is LOW- will not be considered for AOS; hence we decided to get a cosponsor, friends of our inlaws who actually volunteered themselves (we are blessed with people trying to help us!!!). So questions of the day are:

1. If DH does not have sufficient income (and was told he didn't have to file IRS while studying in Canada), does he submit the AOS anyway? Or does he file a letter of some sort? Do tell.

2. I am sending our cosponsors a trial copy of I-864 so they can also begin gathering their documents. Now, in DCF, signatures need or need not be notarized?

Much thanks. Oh! Also another quickie question: my case number begins with MTL2006 something. Yet, when I try going on to the USCIS website, it does not recognize the name. Could it be because we are just in the beggining of the process (haven't received packet 3 yet)? I am sure more questions will continue to come up.

hi, a couple of thoughts:

You'll do better with your questions in the DCF Forum--this type of case is quite different from other MTL (same documents, different process)

AOS generally = Adjustment of Status. There are two Affidavit of Support forms; people will understand better if you stick to specifics: I-864 for youse guys.

There is no such thing as a 'co sponsor'. The I-864 does allow for a Joint Sponsor. You'll find that these little nitpickies actually *do* matter. :)

The I-864 instructions are clear that the principle Sponsor (your spouse) must file I-864 even if income is insufficient. If he was not required to file a US tax return, he should write a statement including the relevant info from IRS that shows he wasn't required to file.

Your Joint Sponsors can download a copy of I-864 or you can send it. Again, the instructions are clear: the document does not need to be notarazed.

You are NOT filing with USCIS--they are nothing to do with you. DCF cases won't appear on the USCIS site because you are filing directly with the Consulate, which belongs to a different department: Department of State. You won't have the same kind of timeline as most posters here, and you won't have the joy of obsessing over a fictitious timeline on a website. :)

The Embassy will be in touch with you; expect 4-6 months from I-130-->visa interview.
