paper DS3032 may stall your case unless u r not in any hurry then thats fine.

hi! i'm also applying for my mom. it got my NOA 2 last January 11, '13. And still waiting for the case ###..

iwas looking at your timeline, you sent the AOS & IV at the same time? is that the same packet?

Can USC send DS-3032 and DS-230 Package As Agent for His Parent?

I've just recently started this process, and am still waiting for I-130 to get approved for my mother, who lives abroad. I am still figuring out all the steps involved, and just when I think I got it, something else confuses me!

Originally, I though my mom will have to file DS-230 with civil documents at the local embassy.

I kept reading the extensive guides here for the CR-1/IR-1 applicants. Then I learned about the DS-3032, and we decided that I'll be her agent and send all the papers from here. We felt it would be more reliable if I am sending documents directly here from the US.

But the guide for parents of USC is very limited and stops at filing the I-130. All it says is that after I-130 is approved, the "parent will be notified to go to the local U.S. consulate to complete his or her visa processing."

So, now I am super confused!

Can I, or can I not, act as mom's agent, and send DS-3032 (via email) after I-130 is approved, and DS-230 with civil documents after I-864 is paid and received?

Anyone here who filed those papers for their parents?

Or can only those filing for a spouse take advantage of acting as their agent?

I am also waiting for the I-130 approval for my Mom. I filed in Dec 2012. Was bit confused with the Parent immigration process. In my case I am in the US and my MOM in the home country. I was hoping that the 130 gets approved by Jan 30th, and then I could sent the ds 230 / 3032 and all the documets from the US. I am travelling to my home country in the first week of Feb and hoping to do the rest of the paper work from home country.

Thank you! That did the trick. :)

She was still annoyed when I interrupted her little spiel of all the ways (email, leave a message...) I can contact them, and said "I'll wait" after she said "or you can wait on hold until they answer". She asked me to let her finish her sentence!

After a 40 min wait, I was able to speak to a very pleasant officer who was in no rush to explain things. Unfortunately, unlike their website, he said 6-8 months is the expected approval time - although I think he is just being on the lets-give-the-max-time-so-they-get-pleased-with-us-when-it's-less side. And that's for any immediate family based petitions.

He also said that no all cases are transferred from NBC to a field office, that they do send out courtesy notice if it is transferred, but that the online system doesn't always reflect the "touch" date or transfer (they are working on it).

I didn't expect much out of this call for our case, anyways. I know it's too early, even for a transfer, which he confirmed, and said if it does get transferred, it will be close to 3-4 months (again on the conservative side, I think). I'll give them a call in couple of months again. At least now I have the experience of how to get through!

Thank you guys!

It seems it's safe to say we can proceed with our plan; me keeping the doc originals, mom having a copy (for just in case) for the interview, me emailing DS-3032 and DS-230 (I have signed versions of both), and mom just waiting for the interview scheduled call and go do the medical.

I was just confused because some folks were saying she should send the ds-230 with doc originals, and even one, probably old, page from our local embassy said that she should not send the documents with ds-230, but bring them to the interview.

At the bottom of the first page it says to "not send these documents by mail to our office. Bring them to the interview." and "bring originals"

Although, I just noticed that, right before that it says that all those documents are required "even if they were already submitted with the application to the USICS". So I guess I was just not reading it right. The documents should be submitted with the application, which I know have to be originals, and they are just saying not to send them (again) to the embassy but bring them to the interview, again originals, or certified copies.

I would consider yourself super lucky if it happened that quickly.

There are only a few dozen I130s they have approved from mid December, and who knows if those were some special, expedited cases. They receive some 3000 I130s every day, plus at least three times that in other applications, so those few that were approved that quickly are really the lucky ones.

I am also in the US, and mom is in her home country. From what I've read, it is advisable to send 3032 and 230 from the US, just because international mail is slower, more expensive, and possibly less reliable. You can still use your time back home to collect all the documents you'll need to send with the application, so you can send it when you get back to the US.( That's assuming you are coming back soon and not planning to wait for your mom to get the visa and travel back with you.) After sending those packages, there is really not much paperwork left to do there. From what I understand, the NVC will schedule the interview, the embassy (or NVC?) will let your mom know when it is and send her the information about the medical exam she'll need to do. Then she just needs to bring that medical info back to the interview, with copies of all the documents you send with the application.

yes I put them each in a separate transparent envelop divider with their cover sheet in front of them and then placed both packages in THE SAME envelop. I did the same thing when i filed for my mom two years agao. For me that saves money and also reduces the chances of false checklist for one or the other. I also kind of think it gets my file processed faster( my opinion only).

Near as I can tell, this document is for the Packet 3.

Packet 3 is gathered up at NVC when chasing after a CR-1/IR-1 visa, and is a bit different than what you see in that sheet.

I'd reread it, and have a rethink, as there's a mention of DS-2001.

That first page gives instructions for what to do on A k-1 visa.

The rest of it appears to be the instructions when handling an IV visa there (not a K-1) when the intake occurs at the Embassy.

To the best of my knowledge, is ok to ignore this sheet - you're doing NVC doc intake, instead.

That still references intake on the I-130 to the Chicago lockbox,

but states the approved petition will be forwarded to the IV unit there,

with no mention of NVC doc intake.

So, if this IV unit is the exception - oh well !

If I were in yer shoes, I'd be calling NVC for clarification.

See now why I was confused. Conflicting information in different places.

I called NVC yesterday. They said that "usually" USCIS will forward the approved petition to them, OR they may send it to the embassy. :) I asked can he confirm, based on the country, where it will go, and he again said he is pretty sure it will go to NVC. I again insisted, "but can you tell me with 100% certainty", and he said I should then call USCIS to check with them where they would send it.

USCIS was not really helpful either. He said that they send all petitions to NVC, but they don't know if NVC will process it or forward it to the embassy.

I then emailed the embassy, and luckily they had a quick response. Even though I referenced their web site page that says the applicant should bring documents to the interview, not send with DS-230, they said that NVC "collects all the documents and schedules interviews. Once the applicant is documentarily qualified, NVC will schedule an interview and forward the applicants package with all the required documents to Embassy."

So, at this point I am tired of asking this question and not getting a definite answer. We will just go with our plan, and in the worst case, if I can't act as the agent, I'll have to send these originals back to Bosnia, which would probably be faster than getting new ones there.

Emailing the DS-3032 (Choice of Agent) is perfectly fine. I used my parents email adds to email the DS-3032 template from the sample here in VJ. It worked. Took about 10 business days. NVC sent the acceptance emails to the applicants ( my parents email adds).

IMO, that's a definitive answer, straight from the horse's mouth.

NVC and the IV unit are both units of the Department of State, same Agency, so if the IV Unit mentions NVC for doc intake, I'd take it as gospel.
