Greetings VJers,

I am getting ready to file for AOS and have a few quick questions.

I really appreciate beforehand any comments or advice you may be able to offer. I did spend a few hours reading through VJ and doing searches, but I still have a few doubts.

I will be filing the I-485 along with the I-765 and the I-131 in the next few days.

In the Advance Parole document (I-131), Pt. 3, it asks for the 1) Date of Intended Departure and, 2) Expected Length of Trip.

My wife would like to be able to visit her family (in Colombia) sometime next year, but we don't have any set plans. Should we just make up a date?

Also, in Part 7, what is the difference in checking "One Trip" intended as opposed to More than One Trip? Is it easier or faster to get approved for the one trip?

Any suggestions for explaining how one qualifies for advance parole, or just a short and simple note -- to visit family, etc.

One final question:

My wife arrived in the U.S. on April 30, 06 on a K-1 Visa and we were married on June 14, 06.

I am just now about to send off the AOS application packet. All of the forms/paperwork seem to be in order and I don't see any problems with our specific case....

But, should I anticipate any problems, since I am filing a little later than normal?

I can’t answer your advance parole questions but...

I wouldn’t worry about filing late, I got here November 2005 married a few weeks later and due to a bad case of Murphy’s Law :hehe: we ended up filing for AOS in April 2006. I got approved about 3 weeks ago and didn’t have any problems.

1. Just give them some date. I didn't know when I wanted to go back and just stated June 2006 and then 4 weeks

2. Check the "more than one trip" option. APs are generally issued for one year and she can travel all she wants to (as long as she doesn't stay out of the US for one year).

3. I just told them that we had a family reunion in June and I got approved. You are paying a bunch of money for it so I don't think you can actually get denied. Visiting family is probably the most stated reason and if it's true...go for it.

4. The requirement is to get married within 90 days which you did do. I would still suggest to send everything of ASAP now, since you have been waiting a long time.

03/26/2008 - case sent to Vermont Service Center

04/17/2008 - Biometrics scheduled

05/19/2008 - received I551 extension stamp via INFOPASS

02/12/2009 - APPROVED

02/21/2009 - GC received...no mistakes...valid until 2019

Roland,

If your wife has any idea of when she would like to visit her country, write it down. If she has no idea at this point 'to be determined' is fine.

One v. multiple trips does not affect application processing time.

A K1 who is pending adjustment of status qualifies for advance parole because they are a K1 pending adjustment of status - why they qualify is something quite different from why they want.
