I received the notice November 23 that my I 130 was approved and sent to NVC. I waited 30 days and called NVC they did not have my file from uscis. I called uscis and they said it was sent to NVC and they won't lunch investigation till 90 days pass or February 23, 2013. I called back NVS and emailed their research email site with NAO2 to find my case or investigate.

What can be done in a situation like that?

If NVC research came back and said they don't have it then you must call USCIS back and ask for a supervisor.

You will ask supervisor to tell you what DATE did your petition physically leave the service center. They must tell you.

I had the same issue my petition was sitting for 30 days (NOA2 6/29, case sent 7/27 received 7/30 at NVC) no one knew where until at CSC the supervisor said "oh its here do u want us to send it to NVC?"

Call first thing tomorrow.

ear Sir/Madam:

Please be advised that the National Visa Center (NVC) has received your inquiry and the attached I-797 Notice of Action - Approval Notice. Unfortunately, we do not have record of receiving your approved petition from U.S. Citizenship and Immigration Services. The NVC will contact USCIS on your behalf for information on the location of this petition.

Sincerely,

Avery

i am on the phone waiting for a supervisor have a question is it worth while to call back the nvc ask them whats next if they issued a I-797 Notice of Action - Approval Notice if they can still issue a case number and me resend the documents to them?

No they will not do that. what you ask the supervisor is to tell you what date your case physically left the service center. They should know more than likely its held up sitting in the mail-room. Mine was for 30 days.

Its better then that the Lees's summit MO 64064 processing center sent it to Chicago instead of the NVC. From the response of the supervisor, i could hear making up a story on why they would do that if it was approved or trying to justify it....... and throwing me off track by trying by asking what the notice says and the dates when the notice clearly states sent to the NVC not chicago what for since its approved.

any way to make a long story short the guy was typing while we were talking i was trying to be nicest as possible not piss the guy off so he can help since i figured i got screwed already don't need to make it worse. He said he sending a contact email to the Chicago office for them to take my application out of the file and send it to the NVC since it already approved.

How long is your guess it will take to get it out of the file and sent to NVC if read or encountered situations like that he said he contacting them sounded like he was typing up an email.
