Applying for Advance Parole for K-1 Visa Holder

I've just read the I-131 document. Under the instructions section on page 2, it states all the different visa categories that are elegible to use the document. K-1 is NOT listed there. What does this mean? Can we not apply for Advance Parole? Can my husband travel outside the US and return without problems?

We are in the process of applying for AOS and all the other "stuff", Advance Parole being part of this. We wish to travel to England and Rome in the spring, but we must be sure he can re-enter the US before we book tickets, etc.

Any help is, as always, most appreciated.

Thank you,

~Liza

I wondered this same question...I wanted to honeymoon in Turks & Caicos, but was told that K1 holders cannot enter the US more than once on the same visa. I was told they could apply for the travel document, but it takes 90 or so days to approve it.

K1 visa holders most definitely need to apply for advance parole, or they will not be allowed to return to the US post trip.

http://www.uscis.gov/files/form/I-131.pdf

Aliens described by section 101(a)(15)(K) of the Act as the fiancé of a U.S. citizen or the minor child(ren) of such fiancé, and are filing based on an approved Form I-129F, Petition for Alien Fiancé(e)

If you entered the US on a K1 and have now got married then you are no longer a K1 visa holder..... you are now an adjustment applicant... AOS

You can not file for I-131 on its own... you can file for I-131 along with your AOS and yes it take about 3 months to get...

There is nothing to stop you leaving the USA but without the AP you cant return...

Thank you - I thought for sure we had to do that. How much trouble would it have been for them to actually LIST K-1 in the list of categories!!!

SHEESH!!!

Thanks --- the battle of the paperwork continues.

Why would they list K1... when a K1 is not eligible for AP....
