Hi all, my husband and I want to visit the US this summer. We have no intention of staying, I just wanted my family to meet my husband and our daughter. I understand that since my husband is married to a USC he has to have overwhelming proof that we will not stay. Other than providing our Rental contract for our apartment, Car payment and other bill statements is there anything else that we can provide that will show overwhelming proof? Also he does have 2 brothers in the states who are USC's. Are the odds stacked against us? I would not want to travel with a 1 year old alone. Thanks!

Does he have a job or enrolled in school? That might help

He has a lot of USC family so the burden is upon him to show that he won't try to stay

good luck

Yes we both have jobs, he works for a construction company and I work at a school. Will we both have to show proof of employment?

Your timeline shows you applied for a CR-1 visa in the past- did he get it? If he got it and then you moved to Lebanon after, there is a good chance of him getting a tourist visa as he held an immigrant visa and then gave back the greencard. If the CR-1 visa got denied, then his chances are minimal as they will be double afraid he uses the tourist visa to immigrate.

We decided not to file since I moved to Lebanon. We were going to do DCF but were unable to since they changed the DCF policy in 2011.

what they (the VOs) will be looking at are the things that bind you to Lebanon...if your current job is considered to be one that is not very high up on the professional scale, then they may well believe that there are no strong economic factors that will motivate you (and husband) to return...in other words, if your current 'ties' to Lebanon are weak, they will assume/presume that you won't care if you come back, and instead will seek employment, etc, in the US, and keep your spouse there as well while you are reestablishing your life in the US...(and that's assuming there are no other issues with your previous I-130 filing, etc)

We never filed the I-130 since we're both living in Lebanon. We just need some strong evidence to prove that we have no intentions of overstaying in the US. What other evidence do we need other than what we have mentioned so far?

With my husband - we had a lot of infomation proving that I - the US citizen was also tied to the non US country. We had my ID card showing my work visa, 4 years of work visa, contract letter from my school. My husband brought a contract from where he works and apartment information. He has entered the US three times since we got married in July and has been taken into secondary inspection all three times. The first time he said he was getting married and he just explained more in secondary inspection, but they never looked at any of his paperwork. The 2nd time we were coming back from our honeymoon and had been in Egypt, Jordan, and Israel so they asked briefly about that. The third time he was visiting my family for Christmas and they sent him to secondary inspection, but never talked to him and told him to leave 10 minutes later. He is going again in about 2 weeks, so we will see if he is now marked to always go to secondary inspection or it has just been a coincidence.

The main issue is Lebanon.

What's secondary inspection? Boiler, what are the issues with Lebanon? I know of loads of Lebanese who have US passports, its fairly common for families to fly to the states just to have their babies there. Then they return to Lebanon because they want their child to grow up here but have US citizenship. No comment on that practice...its just very common here.

You hit it right on the spot improper use of a tourist visa, from others who have gone before you will make it harder for your husband to get one.

Your husband needs to show strong ties as to why he would not remain in the US on a tourist visa. Good luck, it can be done.

Hi there! I am USC spouse and I applied Tourist Visa last 2011 and was granted a 10-year multiple entry Visa. They didn't ask or look for any documents from me though I bought my proofs/evidences of employment, economic, and social ties in my country. It depends on the CO, some asks docs, some do not. Just let your husband bring all your proofs of ties in Lebanon in case the CO will look for one. I visited USA last November 2012. Hope this helps! All the best for your husband's application.
