Hi, im writing from Guatemala, my wife (US citizen) and I are about to start a DCF proccess, she's been living in Guatemala since she was 4 so shes a legal resident, after reading through the information on this site, I think I know the proccess enough to do it on my own, I just have a couple of questions:

When filling the affidavit of support, my wife doesnt have Tax report to show (because almost all her life she has spend it in Guatemala), but her father will be my sponsor (he lives in the US), so, is there any problem if she doesnt show any Tax reports? is it enough to show his reports?

in case my father in law doesnt meet the required income, can my aunt wife act as a second sponsor even though she lives in another house?

third and last, I think I already know the answer to this one but just want to make sure, to establish a domicile can we use my father in law address? (we will be living there, until we get a place of our own)

Basically those are my questions, appreciate your help.

As the main sponsor your wife must fill out the I-864 with the supporting documents, no exception. If she did not file taxes she needs to send and explanation as to why. If you don;t think your father in law fits the required minimum income for joint sponsor it is best if you find someone who can. her aunt can be joint sponsor as long as she is a US citizen or LPR and is domiciled in the US. She cannot combine income with your father in law to meet the income requirements.

Thanks for the info, yes my aunts wife is a US citizen, so she will be acting as a joint sponsor.

On the tax thing, now im totally confused I just read the info on the IRS page, and don't know what to do because she hasnt filled any reports in the last years. She has an income here in Guatemala, and she pays her taxes locally, but don't know what to do with the US taxes

If you wife makes less than a certain amount ($80-90,000) then she probably qualifies for an exclusion and will not owe any taxes at all. I have lived in Guatemala and Brazil for the last 7 years and have not had to pay US taxes on the money I have made abroad. But...she does have to file taxes in the US.

If you wife makes less than a certain amount ($80-90,000) then she probably qualifies for an exclusion and will not owe any taxes at all. I have lived in Guatemala and Brazil for the last 7 years and have not had to pay US taxes on the money I have made abroad. But...she does have to file taxes in the US.

I read all about the exclusion and my wife qualify for that, so now we have to find out how to send the declaration back dated. Can someone tell me if this has to be done by a professional or can she do it by herself?
