Hello VJ members and thanks again for your endless support and feedback. Anyway here's our situation. Just a few weeks ago I had a serious accident that stops me from working and our financial situation kind of fall out of track. The only solution we have is to fly back to San Diego where my wife and my 2 year old son can stay temporarily while I'm doing my surgery recovery. We are now here in Guam and my biggest mistake was that I didn't apply for Advance Parole when I applied for her AOS adjusment of status. My wife already went through biometrics on her AOS and had her interview done on September 13, 2012 and was given a RFE for medical issue that she needed to turn in a I-693 which we did seen a Civil Surgeon here in Guam and has submitted the required documents before Dec 12, 2012 deadline. Just two weeks ago she called USCIS to follow up on her case and she has been told that her case is on Decision Making? We have no clue when and where she will be getting her Green Card, but as of now we had no clue when her GC will be arriving? Now, I read the USCIS Advance Parole instructions stating that if your AOS was processed and pending for approval, you do not need to apply for advance parole? Now since we are only traveling from Guam to San Diego? Would there be a problem since my wife is travelling from US territory to mainland? Do we still need to apply for AP since its US to US travel???? I'm comfused and I desperately need your help. Thank you very much and hope to get some feedback from you guys...

I believe you are correct as that is my understanding also, even though I also know that when entering the United States proper you will being going through a Point of Entry, information on your wife will be in the computer which should show her status. (I don't know this for fact but I have read this before)

It's all up to you whether or not you want to apply for Advance Parole pending the AOS process. I did apply for AP since approval of AOS takes longer than the former, in case i need to leave Guam I can always go back hassle free. For you won't be needing the AP once the GC arrives. In your case, no need to appy for AP, it'll be just an additional expense, just wait for the GC.

AP is not needed to travel to the U.S. or it's possessions/territories. She just need a valid ID and proof that she applied for AOS and she should be good to go.

AOS process in Guam for me took about 3 mos and a couple of days.
