frustrating !!

I am new to this forum, but I can certainly use help!!

Here is my story: I am married to a US-citizen, we lived in the US for many years, have 4 wonderful children ( all US-citizens) and I had a green card.

In 2008 disaster struck, I had to move back to Germany ( with the kids)and my husband is now in prison.

After the dust settled and the kids grew up a little more we are ready to move back to the US; of course my green card has long since expired.

I have filed an I-130 ( actually my husband has filed from the US), but that was back in October and we have not heard back!! Has anybody ever filed out of prison??? Is that doomed from the beginning? Any other way I can move back?? Can I move without a greencard and file for adjustment of status while I am there??

No you cannot move on a tourist visa and adjust status

Yes, if you do a search then you can find successful cases from prison

I should ask, why did he go to prison? Certain crimes will make him ineligible to re-petition for you

Malpractice issues ...lack of malpractice insurance, cases with bad outcomes...

will hiring a lawyer help? Problem is that I cannot even talk to the INS since I am "just" the beneficiary...and him making phone calls from prison is a major issue....will he even recieve the mail??

When you say he filed in October, did he get anything? Ie a notice his papers were received, was his check cashed? If yes, then there is nothing to worry about- you are looking at about half a year until you will hear from them on the next step.
