Hey all,

We did get our I-129f petition approved and are waiting on the packet 3 paper work.

Unfortunately I just found out recently that I am going to have to file an I-601 waiver,

because my fiancée over stayed her VISA for more than 1 year.

I check out some attorney’s and found it can be quite expense to have one do an I-601 waiver. It doesn't look like it should be too difficult to do, but this is very important and I want to make sure it is done right so I probably will be asking many questions. If I don't think I can do it, I will definitely hire an attorney.

My main arguments for hardship would be employment, financial, I don't not speak Spanish, I have a daughter that attends an college I help support and my fiancée and I want to start a family.

I have high blood pressure and have been on medication for many years would this be worth mentioning?

I found this definition of extreme hardship "USCIS loosely defines "extreme hardship" as hardship that is greater than a couple would normally experience due to the government refusing entry to the alien.

I would think that not being able to speak the language of a foreign country and find suitable employment would be considered an extreme hardship.

My question what sort of support documentation are they looking for? I see that many people return to CDJ to submit the I-601 can't it be submitted when you have your interview?

Waiting - go to the 601 forum on immigrate2us.net - you will find great examples of what constitutes example hardship and how to write the letter, etc. You can certainly do it without an attorney if you feel confident, which I think you will after you read through the example letters there.

Financial, not speaking the language and lack of employment are not enough, but along with the other things you mentioned you should be fine, assuming you provide sufficient evidence and proof. Medical-related hardship to you is the strongest argument you can make so you will definitely want to include this along with the information regarding your daughter. Support documentation includes everything and anything you can think of to prove your case - letters from your doctor and medical records will be very important.

CDJ is currently requiring applicants to return two weeks later to submit the waiver and pay the fees - a real pain in the *ss.

Can the waiver and fees be mail in?

Waiver can be mailed within 30 days - fees for the waiver, fingerprints and waiver fees have to be paid at the consulate.
