Im gettting ready to file my taxes for 2012 here in the US. My husband and I were married in March 2012, but not lived together since, due to me coming back here to the US to work and start his visa process. I have heard that because we were married in Morrocco, the marriage isn't recognized here in the US till his visa is complete and he arrives. Does anyone know if this is true???? I do not know how to file my taxes... married, filing seperate... or single, since he is not here yet (will be soon though :) ) Thanks in advance for any help!!

I say: Married Filing Separtely... Why? It shows.... There is no gain or loss to your return. But, it shows you claimed the truth.

if your married then you must file as married, you can file your taxes as married file togather joinly, or you can file as married but single filing. i don't matter if you where married in marocco or if she dont work, get a itin number from the IRs.govdownload the w-7 form to get the itin number to use for your tax returns,best if the beneficary downloads the w-7 fills it an signs it and sends to you the us citizen the you sign it date along with all your ID READ THE INSTRUCTIONS CAREFULLY,

there's a cool option, for 'married filing jointly'

you fill out the tax form, both spouses sign it.

foreign spouse fills out the w-7 form, signs it.

the two of you sign a letter that states the two of you are electing that the foreign spouse be considered a resident alien for tax purposes.

submit all into the special w-7 intake address in Austin TX.

expect a paper check on the refund.

Yes, and there are new ID requirements that require it not to be a notarized copy, but a certified copy from the issuing agency.

Before my husband arrived, I filed as Head of Household because I have a qualifying child. Go to IRS website to see what the criteria is.

To answer your other question, if you married according to Moroccan laws, then your marriage is legal here in the U.S. that is the purpose of a CR-1 visa. He can't come here without it.

Timeline

If you file as married filing jointly, then your overseas spouse has to include his income on the return. Basically you both have to include your "worldwide income" on the return. So if by chance, your nonresident spouse has significant income, maybe you don't want to file joint. If you file a joint return, he is electing to be treated as a resident for tax purposes. If he does have significant income, he would not have an obligation to file a US return until he becomes a tax resident or elects to be such. If he has little or no income, then it might be advantageous to file a joint return.

From what I know as long as your spouse step into this country even for one day in 2012 you can file jointly. Check with your accountant.
