It has been 204 days since I have sent in my I-130 petition at VSC for my husband and still no answer. I have been calling USCIS since the end of November, when our 5 months was up (which was the given processing time.) Of course, when our time is here, the processing date gets changed to the last date of the application they finished, making the '5 month processing time' void. Around December 18, I called again and spoke to a woman who told me I should have received something in this time period. She then submitted a service request for an approval notice and gave me a referral number. She told to me to call back after the 1st of January and find out how my service request is doing. She told me that I will receive an approval notice within the first 2 weeks of January 2013. I called today and spoke to another woman, I asked her could she update me on the progress of my service request, I have a reference number. She told me she is unable to look up reference numbers. I told her that I was supposed to get an approval notice within these 2 weeks and someone was supposed to update me on my service request. She told me the other agent never should have told me that because my application is still within the normal processing time. But when I asked her to tell me what the 'normal processing time' was, (since there is none listed, there has just been the same date for over a month now), she told me to hold on while she talked to her supervisor. So I asked her, was my service request denied and she could not answer. I then asked her what my options are now, since they destroyed my ounce of hope and she said to just wait. That is when she basically read to me the USCIS website word for word, that my petition was received June 13 and I received NOA...blah blah...and that they are still on May 21, 2012.

Everytime I call, they keep delaying me or telling me things I already know.

My application is in limbo, I have no idea if they need more evidence, if there is an issue, or what. That will just be another month or more added if they need additional information...

But what kind of place are they running, that one agent tells me one thing and the other basically calls her a liar?

I have seen a June 8 filer at VSC on Visa Journey who received NOA2 on November 13 and their interview is January 30. It is so stressful to think how close our dates are and yet our waiting is so much longer.

I also did some reading on Visa Journey from a former USCIS Adjudicator. Made me even more annoyed and sad, we are waiting this long just for them to quickly browse our applications...

Quoting:

Q: How long does a "typical" non-RFE case require to adjudicate?

A: That having been said... I could crank out an "approval" in about 15 minutes depending upon the complexity of the petition. I recall that we'd love to see those large family petitions with the little kids. Why? Because once you clear the mom and dad, the kids went really fast and you could get several "credits" very quickly that way instead of having to do the equal number of "individual" petitions for the same amount of "credits". But you have to be fast and thorough, because its your job to be fast and thorough you might say...

(I can't post links, but this is where I read this from)

I am beginning to wonder if the new fee has anything to do with it, if they are delaying people for this reason.

Effective Feb 1, 2013 a new fee of $165 has been added. I would gladly pay them now, if thats what they are after.

Keep in mind , just because they say May 28th doesn't mean they are past working on applications from the beginning of May also. My senators office said that May 4th is still considered within the normal processing even though they are processing up to the end of May. The date they show isn't set in stone and varies greatly.

Seems to me that destiny has told you what is considered too long. 30 days outside of normal processing times is too long. I've heard this over and over and tend to believe it. Though I will continue to try to submit service requests after my priority date has been reached on the website, just in case.
